We are a UK married couple and have now been issued with O A Long stay visa for my husband and I have a single entry Non immigrant O visa issued as a dependent by Thai Embassy in London. . All documents including my marriage certificate were accepted at the Thai Embassy in UK. A copy of my marriage certificate was signed and stamped by a UK solicitor and this as deemed acceptable. I also have original certificate. So no issues here in UK.

My concerns are when I apply for extension of my non O visa as a dependent once in Thailand. Will they accept my original marriage certificate and signed copy by UK solicitor? I have heard rumours that this is not enough and it needs additional verification? We will be using Hua Hin Immigration so if anyone has any recent experience of extending as a spouse and any issues please could you advise.

You will not need the notarized copy for immigration. Just your signature is all that is required on the copy.

Some immigration want the marriage certificate to be certified by the UK embassy. To satisfy this requirement an affirmation done by you that it is true and valid done at the embassy will be accepted.

If you have not registered your foreign marriage yet at an Amphoe you will need a lot more than the MFA certification. You will need Kor Ror 22 to prove the registration to apply for an extension of stay (not a visa) at immigration.

To register your marriage you will need a certification of your marriage certificate from your embassy. Then have it and your marriage certificate translated to Thai and then have the translation certified by the MFA. Most translation services can do the MFA certification for you.

The Embassy will only certify copies of a British passport, UK degree certificates and British driving licences - https://www.gov.uk/guidance/notarial-and-documentary-services-guide-for-thailand and scroll down.

In the case of your marriage certificate, therefore, you will need to go through the legalisation process described at https://www.gov.uk/get-document-legalised.

It would appear that there is no way of avoiding this cumbersome procedure in your case, unfortunately.

Things have apparently changed since I did the post you quoted that was done over 2 months ago.

Ah, didn't spot the dates and realise that this thread actually predated the one she originated at http://www.thaivisa.com/forum/topic/904437-uk-marriage-certificate-needs-letter-from-british-embassy/!

Hopefully she has now been able to scrape together sufficient income for a retirement extension instead.

coming back to Thailand in June 16 with my extension of stay in the passport valid until 04.08.2016 , I will proceed immediately to my place of permanent residence in Banglamung . Im registered with the Immigration in Joimtien. Does the 24 hour Report rule apply to me ???? see hereafter : House holder, owner or dwelling occupier or hotel manager who accommodates the alien who has permission to stay in the Kingdom temporarily, must report to the officer within 24 hours from the time the alien was accommodated by using TM.30 form. How to report of accommodating alien 1. Report personally or assign another. 2. Report through registered post mail. 3. Report through internet. Remark Failure to report will cause not more than 5000 baht penalty fine."

Jomtien has not been enforcing the requirement for the TM30 for those on extensions unless they change addresses.

You seem to be listing the procedures and fine for 90 day reporting. The max fine for not doing a TM30 is 2000 baht and at most offices it has to be done in person.

Dear Ubonjoe ,

thank you very much. I referred to the following section, pls, advise if applicable to me or others with the same Extension of stay in the passport and return to Thailand. In this respect especially the 24 hours Report rule ???:

According to section 38 of the 1979 immigration act, "House owners, heads of household, landlords or managers of hotels who accommodate foreign nationals on a temporary basis who stay in the kingdom legally, must notify the local immigration authorities within 24 hours from the time of arrival of the foreign national." If there is no immigration office in the province or locality of the respective house or hotel, the notification is made to the local police station. In Bangkok the notification is made to the Immigration Bureau. The notification of residence of foreign nationals is made by the manager of licensed hotels according to the hotel act, owners of guesthouses, mansions, apartments and rented houses using the form TM. 30.
The notification of residence of foreign nationals within 24 hours can be made in a number of ways to make the notification as convenient as possible:

  • In person at the respective office, or
  • Through an authorised person at the respective office, or
  • By registered mail, or
  • Via internet.

Not all offices enforce that section of the Act.

Best inquire at your local office in respect of what they require.

What you posted is from the immigration website.

The immigration act does not mention mailed in reports so some offices do not accept them by mail.

Enforcement is random dependent upon the office you report to. Jomtien has been reported as not requiring them unless you have moved.

thanking you for your reply Ubonjoe , I wish to raise the question :

Having filed the TM 30 every year with the paperwork for the extension application based on marriage , meaning Im registered with my 1 rst residence at the captioned Immigration I dont understand why other Immigration offices randomly apply the 24 hours report rule when moving immediately aftter the return to Thailand to my 1 . residence place ????
