Can I get a dependency visa based on a Thai marriage when both of us are British?

May sound like a daft question but my friends (both Canadian) tried to do it a few years ago and were told it had to be a foreign marriage if both parties are foreign nationals. I'm wondering if anybody knows if it has changed?

There is no visa or extension of stay based upon marriage for foreign couples.

There is a dependent extension that is possible for the spouse of person that has an extension of stay.

There is no "dependency visa"

If you are both "British" no visa or extension of stay based on marriage is available.

One of the partners has to be Thai before those possibilities become available.

Were one of you able to secure an extension of stay for a reason other than marriage then an extension based on dependency is possible.

If you set out what you are seeking to achieve more focused advice may be available.

I wasn't clear in my original post, sorry.

My husband-to-be is on a non-B visa. The HR people were he works assure us that I can get a dependency visa but I'm not sure they have experience of doing this when the marriage took place between two foreigners in Thailand. I know they have experience were the foreigners were married in their home countries.

Can anybody shed any light? Thank you.

you can piggy back his Extension not Visa, has be reported to Immigration within Thailand? If so, then you can apply as his dependant

If your husband has an extension of stay based on work then you can get an extension based on being his dependent. You will need to first obtain a single entry "O " visa from a nearby country (You will need the marriage cert. and copies of your husbands passport including his visa and extension)

An extension based on dependency can then be applied for during the last 30 days of the 90 the visa will provide.

There should be no difficulty and the fact that you have a Thai marriage certificate is irrelevant. I am unsure why you are doubting what the HR people are saying.

I'm doubting what they are saying because I know they've cocked up many times in the past and because my friend was refused in the past, as mentioned in my first post.

People often wrongly refer to extensions of stay as visas. Your husband may have an extension of stay already.

  • Your husband needs to have an extension of stay based on his work in order for you to have an extension of stay as his spouse (not dependant).
  • If he currently has a valid visa and is doing 90 days border runs then the first thing he needs to do is apply for a 1 year extension of stay based on his work. It can be done in the last 30 (maybe 45) days of any 90 day permit to stay.
  • You need to get a non 'O' visa outside of Thailand, and on re-entry to the country you'll be granted a 90 day stay. Within the last 30/45 days you can then go to the local immigration office and be granted an extension of stay. Your extension will linked to your husbands.
