I've recently moved to Bangkok a week ago and I got my temporary work permit valid for 3 months. However, the company I'm employed at is a BOI company and I think I need to get BOI clearance. So far, they have not been accepting my application stating that I don't have enough experience to be a manager etc. Is there any way that I can legally continue to work here without having a BOI clearance?

Your employer can apply for your work permit without getting the BOI's approval as far as I know. It only makes it easier if they get their approval.

About the main subject : a BOI promote company can also request non-BOI employees but through the normal way,ie cannot go to OSOS office,need the 2M THB capital,4 thais etc as a "normal" company.

 

To get a status of BOI expert,you need to be usually "skilled" or by recognized school certificate and,if they didnt change,3 years of experience, or no certificate and 7 years experience (to confirm with OSOS office by simple call). Your company needs also to request an empty positon as the BOI experts have a limited amount and required positions are always under approval first.

I also forgot : in case of "high-level executive" BOI position,they usually dont request a specific transfer of knowledge so you can try to negociate your skills for this level to them (highly successful business in another country as manager but less than 7Y experience, by exemple).

Usually the BOI will request evidence that you have the required experience for the position you will hold. I had to do this when the company I work for upgraded my position. The BOI wanted a letter from a former employer stating I had worked for them previously and describing the position I held with them. As another poster mentioned, there are certain minimums for years of experience. If you can provide a letter like I did and show a timeline of work experience that meets the minimums, you should be OK. The BOI is generally not obstructionist.

 

If you can't meet the BOI's requirements, you can still get a work permit. Your employer will simply have to pay you more (on the books anyway) and jump through a few more hoops. But it is doable.

Yes, it's easier to type in 'BOI' and I assume that the people in a forum discussing about  Visa, extensions, work permit, immigration and residency in Thailand would know what BOI stands for. :)

Thank you for the information. Well I'm not yet at a managerial position, but I was hired because I have job specific skills pertaining to my industry.

You could try again with the BOI but get your boss to explain clearly why you have essential skills for his Business and to state that they cannot hire a Thai with the correct skills.  As I understand it you will still need to show five years of experience even with applying for a work permit through the department of labour the "normal" way.  Through the BOI they can waive the normal requirements if your skills are essential to the business.  Your employer may have to show evidence that they already advertised the position or otherwise tried to find a Thai.  Good luck!

Thank you for the information. :) I already got a temporary work permit for three months. Is it possible to renew that one and not get the BOI clearance? I got it despite my 5 years work experience.

You can try but generally they are more strict when applying for the year long extension than they are in giving the temporary work permit.  If your boss will cooperate and explain why you're essential in a letter then I'd consider it less risky to go through the BOI.  Another angle to try is to explain how you help them to get international business (exports) they love that.  (Assuming your company does get international business of course)
