Lao citizen overstay?

Featured Replies

Three years over, he's up country in Issan with a Thai gf. Wants to know what his options are. Is it the same for the rest of us- go to the airport pay the 20k and hope they don't ban for a few years, or is Asean different? Don't know what hos original visa was, if any.

It is the same for him as for anybody else.

If he sneaked into the country he would have the leave the same way or could be charged with being in the country illegally,

Yes that's what I thought, thanks, what ban might he get from coming back?

One to 3 years is a 3 year ban. Over 3 years  is 5 years.

I'll let him know, he's hiding out at a friends house. Thanks again Joe

Laos? Why doesn't he just hop on a small fishing boat across the Mekong, they come and go as they please. In fact, in provinces bordering Thailand, Laos don't even need a passport, just an ID Card.

My wife's large, extended family are from Laos.  Most of them are in Thailand (Pattaya), and many of them are either on overstays or don't even have passports.  When they return to Laos (via the Chong Mek border) they seem to pay a minimal fine (they don't have much money!) and never seem to have a problem returning through the same border a few weeks later.  Obviously this is not what is supposed to happen, but in practice it does (up to now anyway), although other border points may well be different.

Yep they only need an id but on the Lao side they pay ฿150 to the Lao police & receive a slip of paper with a stamp, dated.
On the Thai side they pay the Thai police ฿20 but have to explain the reason for the visit, more so if they're not returning the same day. Such as hospital visit, or seeing family.
On the way out they show the Thai police the slip of paper, they tear off a piece then the other part is to given back to the Lao police.
No slip of paper, big problem. Big bribe or taken in regardless. Days of just nipping across to work the fields etc are gone. It was the Lao side they had to avoid then, Thai no problem. Now it's the opposite.
But there are boats that sneak people in & out in the dead of night, before sunrise. Just dam ropey, but if a 5 year ban is on the cards...?

Did have a work visa, now Thai wife and kid now so does not actually want to go back. He's worried that her relatives who don't like him are going to dob him in.

Girlfriend or wife?

One possible work around for a Lao is if he kept his name in the family book, then when the naibaan updates it (was every year previously at ours but now about every 3 & different for each naibaan) he can change his name & obtain a new passport. Will cost a bit. But go back fresh.
May be problem if married then want an extension of stay later.
My wife has, or had, 3 names & the one in her passport is not her given name at birth.

Says wife but probably gf and baba

Says wife but probably gf and baba

Yes. The original post referred to a "girlfriend" but the last one said "wife". It could make quite a difference.
