Need advice on overstay for medical reasons or an alternate solution

Hi There,

 

I have been struck with severe Tinnitus and Hypercacusis.
 
I won't get into details, but it's hell on earth, I have a 13000 hertz ringing in my ear 24/7, every noise is excruciatingly loud.
 
This condition might get better, but my ears need healing for about 3-6 months of quiet, so can't take the plane (loud, pressure), can't take the bus or van. My condition is still in the acute phase, so there is still hope for healing but I must be quiet, if I get exposed to noise the condition could become chronic and I will be like this for life...even with plugs and earmuffs the sensitivity is unreal, like bionic ears...
 
I got an extension at immigration with a letter from hospital, it was for 20 days or so, they granted it to me, but 20 days later my condition worsened, so missed my second visa run...Pattaya immigration won't give me another extension, but that might simply be the wrong guy in the office, can I go over his head and email immigration head office Thailand and ask them?
 
So what are my options now? Can my embassy help me, I need about 3-6 months.
 
I don't care about paying overstay, as long as they don't deport me and put me in jail....I just want protection from the criminal overstay aspect of this situation. I have all hospital documents ect...

You could of gotten another extension for medical treatment if you have a letter from the doctor stating you cannot travel.

If you are only on a short overstay now immigration would do another extension after you pay the overstay fine of 500 baht per day.

If you get to the point of overstaying for more than 90 days you could be banned from returning to the country for one year.

They are wrong .There is nothing in the clause of the police order stating only one can be applied for. The only limit is that they can only be issued up to 90 days.

See clause 2.25 of  Police Order 327/2557  basis for extension of stay.

Great, not the first time they do something like that...

 

The guy was an <deleted>, he was speaking really loud, maybe on purpose?

 

Do you have a contact email for someone high up at immigration? This guy in Jomptien won't budge, and bringing him the documents will make him more angry and resistant...

 

Additionally, do you have the document in Thai also?

You can always ask to talk to a supervisor or a higher ranking officer. I have no contact info for immigration.

Did you have new supporting documents from your doctor/hospital.

Just a couple of drops of garlic oil in olive oil in use a dropper and put 2-3 drops in each ear. I emphasise with you as my son has had this condition for over 14yrs. He went totally deaf after about 2 yrs but can still hear the ringing in his ears. You must seek treatment as the longer its left untreated the more likely you will lose your hearing forever. I have heard of people being cured but it seems if you seek treatment within a few days of it first occurring it is more likely to succede. Chok Dee

If your condition is as bad as you claim, you should be under medical supervision. Why don't you get yourself admitted into a  hospital. And let them deal with the immigration problem. Or ask a Thai friend to go to immigration with your passport and tell them that you are in hospital You don't have to take a private room so it can be cheap if you share with others. Although, I understand the problem with tinnitus ,I don't think an immigration officer would, and therefore be a bit suspicious of your reasons to stay on in Thailand. I'm sure that many people try all sorts of medical reasons just to be able to stay on here.

There is no published limit on how many extensions you can have, but it's up to the individual office how many they will issue. These extensions can be as long as 90 days. I appreciate that flying might be an issue for an ear problem, but I doubt it stops you exiting by land, and I expect they would see it the same way. All they are interested in is that you can exit, and it doesn't matter how or where to.

 

If Jomtien won't help, you should leave asap and re-enter with a new permit to stay using Tourist Visa Exemption (15 or 30 days) or a Tourist Visa (60 days). Either entry can be extended by 30 days at immigration. After that, if you can get a doctor to confirm you can't travel, you could try Jontiem again, or apply in Bangkok by using a Bangkok address. Out/in visa exempt entries are not available at all borders and might not be given if you have an overstay. Getting a Tourist Visa is probably the sensible option.

I asked them, no answer, I sent them an email and I can't use the phone...!

Yes indeed, I don't want to get into details, but this is REALLY bad...however there are no physical signs...although I do have hearing loss from the tests

Hi Baneko, yes indeed, but I have hypercacusis also, my case is really bad 1/50 000, every sound is excruciatingly painful, even typing this.

 

I can't even really leave my room now.

 

If I stay quiet for a few months I will be ok, if I travel I might be like this for life...

Have you received any new documentation from the hospital stating that you are not medically fit to travel?

so far you have only mentioned the initial 20 days that you got paperwork for from the hospital.

reading into what you mentioned in your OP this extension has already expired.

i feel sorry for you with your condition however if you don't get new paperwork sorted soon then in my opinion you are going to have to do a visa run as soon as possible otherwise the overstay situation is going to get on top of you and could cause you a whole lot of problems in the future.

Talk to a high ranking one, ask for their supervisor. By law, they need to give you another extension. 

If the one in higher rank also refuses, get a lawyer and have him talk on your behalf. 

Whether they help you or not, or what they are willing to grant has absolutely nothing to do with rules etc and how it is supposed to be done officially. 

Just do it the Thai way and doors will open. It's all about who you talk to and who talks on your behalf. 

The embassy can be helpful as well, but that's exactly the same. If an a$$*@le is sitting there when you visit, they will say they can't help. If the person in question is a proper human being, assistance will be granted in no time.

There is no law compelling them to issue an extension. Extensions are entirely at the discretion of immigration. Appealing is pointless without the support of a doctor, and a lawyer would be a waste of time and money.

But there's also no law that states that they cannot issue it if they wanted to. I am not talking about appealing. I am saying, from a lot of personal experience, it doesn't matter what they say. Or what the law says since they keep breaking the laws. 

it's all about talking to the right people and the right lawyer is gold, when it comes to that. It's not a waste of money, only from an uneducated perspective.

There must be certain guidelines to follow up for any IO as well. Not sure if they really can refuse a medical statement from Hospital.

Wouldnt that mean loss of face for the corresponding Doctor , and since Hospital Director has to sign as well  ???

         I'm sorry, but that sounds pathetic. A doctor's note would have helped you, but now you're getting deeper and deeper inside something where no e-mail to anybody will help you out.

 

          Choose a specialist and let them get in touch with Immigration, would be my advice.

Go to a lawyer.(Immigration lawyer with good contacts to Immigration; can be found in craigslisg Thailand)  Lawyer will get in contact with your doctor to discuss your health issue.  The lawyer then will phrase the application and visit the immigration in person. He will know how to  proof that you cannot travel. Dont worry, you can stay.
