I have been told that a new one million baht company cannot employ a foreigner regardless if married to a Thai or not.

I was under the impression that the law allowed a foreign spouse to set up a one million baht company to support his family.

Am I correct in assuming that this is a misinterpretation of the law and the company can employ the foreign spouse but cannot employ other foreigners?

I had been with my wife to the Labor Department in Samutprakarn on Wednesday. We have registered a company in September (for 1 million THB) and after that i was away for a month and a half to rope in suppliers and customers outside Thailand. So this is going to be a real company not just a company for hecks sake. Although my wife is the major shareholder I will be looking after the company. We were told by the Labor department that it should not be a problem, they advised us that we have to submit the marriage certificate and the birth certificate of our daughter along with the other requirements.

So far so good. But they said they will check the company premises. Now arises the problem. The address we registered the company is the home address of Mom-in-law. This was a temporary measure so that i could get my work permit and get the company started by looking for a place and set things up as my wife is already working for another company and will quit at the end of Jan to help me. We cannot start at the current place we stay as the premises is not big enough to set up working space for the company. So we will be moving to another place beginning Jan. So if i cant get a work permit before we set up it is a big mess i am in. Someone please advice as to how to go about this.

This is one of the more important things Labour department wants to see, the place of employment!

Normally they would accept a good set of pictures clearly showing the company name on the premises, but lacking that they probably want to actually check the place out...

If you were at the Labour Department in Samutprakarn on Wednesday you certainly have my sympathy as I know the traffic there is just hel_l at the moment with all the work going on, on the Srinakarin Road.

I think the workers at that particular office would welcome an excuse to go out to inspect your business premises.

I don’t know the nature of your business but what I am doing in the first few months is to use the service of a virtual office.

One million Baht is fine unless its a foreign company. Then even if you are married, it has to be at least two million Baht.

The company I work for is registered at 1 million baht and is 100% Thai owned,would I be able to get my Non-B and work permit without raising the capital of the company to 2 million baht?

You will be able to, if you are married to a Thai.
