Hello guys,

 

My company would like to send me to work in Thailand in their branch office and we are aware that a work permit is needed. It is an IT company.

Would you please provide me with a specific information about what is needed to be done by my company in order to obtain the work permit for me?

Requirements can vary so your company need to contact their local labour office who will advise what they require.

I remember that before there were some prerequisites to employ a foreigner such as company must have the annual money turnover of 2 million Baht, six Thais to be employed or something similar.

 

Do you maybe know what the prerequisites are for companies in order to employ a foreigner?

Just keep in mind if you don't have or don't get help to get a Non Immigrant visa and it doesn't seem to happening for a while you are most likely not going to see a work permit.

Plus legally you really can't work until you have work permit in your hands.

Yes you can get a WP on an O visa although some companies will tell you it must be a B. I have had many on my O's but you need to stick to your guns on that one. I have been lucky in that the people I worked for accepted that and were happy to let me do 90 day in/outs on my multi O's. One even paid for for the flights every 90.

Plus if the job ends you keep the visa because it's yours. If you go on the extension of stay option, ie report to Imm' every 90 days then the day your work finishes your extension finishes and you get 7 days to leave Thailand and get yourself another type of visa or extension etc.

The general rules are 2m baht in paid up capital, and 4 Thai employees for each work permit.

 

If you want an extension of stay based on your job/work permit you'll need to be paid at least 50K baht per month income. As you're married it's better to get an extension based on marriage so your permit to stay isn't connected to your work.

If you have a Non O visa and are waiting to extend stay based on marriage, can you sign a contract to work?

 

Does not the wp and visa have matching dates?

Yes you can. Signing a contract doesn't affect anything, but you cannot start to work until the WP has been issued.

 

No. The WP should be issued with a Non 'O' visa entry or an extension of stay (not a visa) as long as you are married. All the labour office are interested in is that you have a valid qualifying permit to stay.

If it is registered branch or regional office only 1 Thai employee per work permit is needed. There are other different rules for branch offices.

The company should know what is needed to get the work permit.

If you or you company contact your local labour office they provide a list of what is required for your type of business. You are not going to get a definitive list for your situation here or on the internet although many of the requirements listed on the BOI website will apply to you.

They 'normally' just ask you for the 1900 baht, I think it is, and give 7 days for that rather than just state you have 24 hours and tell you to leave.
