BANGKOK: -- THE Agriculture Ministry yesterday defended the decision by the Agricultural Land Reform Office (ALRO) to lease land to wind-farm operators that should have been distributed to poor farmers.

 

The ministry said the Supreme Administrative Court did not say that the office was derelict in its duty, but pointed to a breach of contract by the private wind farm developer.

 

A wind farm in the northeastern province of Chaiyaphum was located on ALRO land. 

 

Following a complaint, the court pointed out that the wind-farm operation did not directly benefit farmers nearby, which is one of the prime conditions for use of ALRO land, Sompong Inthong, secretary-general of the ALRO has said.

Completely irresponsible and reckless of the SAC to rule on anything that is not related to the legal issue before the Court - dereliction of government duty. Especially to render a legal opinion on an issue that doesn't legally exist in the court system nor allow the defendants to argue against the alleged breach of contract.  SAC has effectively deprived the wind farm operators of due process of law.

Situation normal in Thailand.

The message to investors is don't expect fair judicial treatment in Thailand.

Tie a rag to a prop, set up a market to sell meat and or fruit tables beneath it and it keeps the flies away, thus the farmers get benifit. Do these people ever set down and look at the pros and cons of a project and its affect on everyone within eyesight, from their self proclaimed high status termite mound?
