Non-ED visa overstay

Featured Replies

Hello guys, could you tell me what you can do in this situation?

I found out today that I had 1 month of overtstay, when I asked the administrator of the Sandy school to prepare the documents. As the administrator claims, it's my fault.

It was a surprise to me to learn that a student visa in Bangkok must be renewed every 2 months. Not every 90 days. Only 60. And in some schools even less - only 30.

Seems i have to pay 15k baht, right? :-(

If you went tomorrow it would be 25 days of overstay which would be 12,500 baht at 500 baht per day.

Not sure if they will accept your application which would mean leaving for a new non-ed visa and paying the overstay on departure from the country.

You should of checked your stamp to be sure the date was what you expected to get. The school should of told you what you would be getting though.

Yes you are on overstay since February 18th. You'll be charged 500 baht per day when you leave. As of today it's 12,000 baht (24 days).

Administrator of school claims that they notified me.

To me it seems impossible to miss the day of a stamp in your passport. That is the document you have for stay in Thailand. Why somebody would just not look at the stamp and believe that everything is like they think, is unbelievable and stupid out of this earth!

However, of course you will have to pay the overstay fee. Right, indeed! After that I would be really careful with my explainations, and just be all too nice with a big smile included a wai out of this earth. Then you might just get clear.

No really, I am joking with you. If everything works fine and you get to where you need to go, before somebody arrest you it would look like it can work fine. Just be careful and don´t do it again. It´s always a big help to read your stamp. It tells you for sure how long time you are allowed to stay! Good Luck!

You could try getting a new non 'ED' visa or simply re-enter using a Tourist Visa. You can study using any type of entry. A Tourist Visa entry and a 30 day extension will give you 90 days.

Yeah, seems obtaining a education visa just make more troubles than it costs

I don't mean to sound like I am giving you a hard time, but your visa is your responsibility.  Every foreigner living in Thailand should make their visa their top priority and ensure that they are always legal.  Don't trust anyone else with your visa and if you do enlist the help of someone to help extend or provide paperwork or anything like that, make sure you know exactly what is going on....and if it gets close to the expiry date and they have not done for you what they said they would, make alternative arrangements.

With the overstay laws and the possibility of being blacklisted / barred from returning for a period of time, you really have to stay on top of your visa!

It's a "trust authority" thing - someone at the school said 'X', so the OP trusted them.  It would be in their interest to keep students "in the clear" with Immigration, no?  But they didn't follow through, then claimed they had.

It is an adjustment in thinking coming here - realizing this type of thing is "normal" - and realizing that the ONLY thing that matters, is the ink-date in that passport - and even then, someone could have made a mistake on the stamp (and may fine you for their mistake), so review the rules and triple-check everything.
