overstay problems

Featured Replies

i am to leave 8th of june but my last tourist visa [3th from penang] expired 20th of may. wath happens at bkk airport when i go through immigration to

board my plane ? due to financial issues i think of taking my chances and not go for a borderrun to malasia for a 30 day entry without visa

You will be charged 500 baht for every day you overstay (18 x 500 = 9,000 baht). When you get to passport control they will see the overstay and send you to the overstay desk to pay your fine and get stamped out. You will get an overstay stamp in your passport.

If you haven't extended already, it would be better to get a 30 day extension from immigration that costs 1,900 baht. If you go  tomorrow they should still give you an extension if you pay the 4 day overstay (2,000 baht).

Did you get a 30 day extension of your 60 day entry from your tourist visa. Most office would still do the extension after you paid the 500 baht per day overstay.

If you went tomorrow it would be a 2000 baht fine plus 1900 baht for the extension.

This was posted on TV in response to the same question: "If a person can't pay the fine they need to first clear the fine by appearing in court, receive a sentence, do the time in a regular prison, and finally be transferred to IDC and await deportation."

You get 200B deduction per day in jail though, I was told.

So, yes, clearly the best option is to find the 3,900 Baht today and go to Immigration tomorrow.

You would be arrested, and sent to the International Detention Centre. You would be held there until you've been to court, and until your flight out of the country.

That is bad advice/information. It is highly unlikely that a prison sentence would be handed down. The court will impose a fine of up to 20K, but likely to only be a few thousand baht. After being found guilty of overstaying in the court they would be held at the IDC until they fly out of the country. It is possible to held at the IDC indefinitely if the person cannot buy a flight back to their home country.

Well, the gist of both comments is that people who cannot pay the fines will end up locked away and I guess that´s the main thing the OP should be concerned about.

You will be held at the immigration detention center until you can raise the money for a full price ticket on your national carrier to your home country. You are very unlikely to be able to travel anywhere else, or travel on a low cost airline as you will be undergoing deportation. Any existing flight ticket you hold will probably become waste paper. Unless you have family/friends who will help you out, you will be in the IDC for quite a long time.

For goodness sake, find some way, any way, to raise enough money for a border hop or extension of stay immediately. You are setting yourself up for a world of hurt.

If you are Dutch and in  BKK give me a PM.
