    What they're really want to say is that this rule is not being enforced, and they are trying to rid the country of criminals and those working in jobs that Thai's could do.

    If you're a digital nomad (or a millionaire playboy) it's interesting to know what the immigration and police departments deem worthy of enforcement.

    The sanctimonious old codgers will continue to shout (where their ailing lungs allow) about their strict interpretation of the law and resentfully wish for the days of the 1900's when they were the only white man in town, and treated like the rare birds that they know themselves to be.

    I do respectfully and humble; while doing so genuily, dare to ask an exact definition of a digital nomad?

    Is it some random snipets of code who wander in the network, the so called 'angels' back in the 70' (term used in some Phd thesis at that time)?????

    Or is a 'catch-all' word, used to easily define a group of human being unable to find a decent employment in their own country (too many candidates, so only the top best are selected) or in this country (too many candidates, even with top best out, so only the very best can compete)?

    I do understand people such as Steve Jobs, Mark Zuckenberg or Bill Gates can, is they so choose, became digital nomads and earn billions a day working remotly; what I do not grasp is the same naming being used by Joe Smith, Mr Allcome, or a noboddy who barely get enought to buy a Chang in 7/11?

    You may, if you please, P.M. and decline your qualities on the related field. Being who I am, with the qualifications I have, I rarely got any trouble to land a decent job with decent salary (6 digits a bare minimum in tbh) in the related field. Most of the so called digital nomad, SEO expert, coding guru, or whatever name; are usualy OR incompetent (at best not at the level they claim) OR lazy (unable to provide the amount of work a decent employer expect from employees) OR total fraud (sometimes the 3 at the same time).

    LAst, being an old codger myself (or about, I prefer to define myself as old french fart), I found both pathetic and humoristic kids trying to explain me what life is about (they certainly did not pee where I did, and will never do so) , while on the same time trying to explain me what my work is about (digital nomad is anathema to most the specialities they claim to master). There are works that can be done remote (Sun promoted it, I believe Apple did it also at one time); but there are others that are not possible, depending too much of the local conditions of the network (and that is starter , easy to understand by layman people; obviously there is more to say about it, but it will become too much tech blahblah for that place).

    So, in Thailand, the real Digital Nomad must be very very little, I would guess less than a hundred; and yes Immigration will turn a blind eye on them, because they make LOT of money to come here (and I do know it well, having the firt experience in 2003/2005 in Lopburi); here we are talking about well over 6 digits a month on a regulary basis. All the others, fighting to get a living at best in Thai standard (mean earning about 20 000) have no right , legaly AND moraly to claim for anything but the same as everyone. They get a visa allowing to do so, if there is not, then they shall move on; if they are high end residents I am quite sure LOT OF COUNTRIES will accept them .... In fact I do not even understand while they are still here, other expats do not love them, locals do not provide them with legal documentation, police want to expel them. Why are they still here??????????????

    Without knowing anything about the industry he works in I can safly say he likes to watch dog porn, I base this thesis on some random inclination that I just happen to have adopted and therefore consider it fact unless signed certification is produced by a dog.

The issue of a work permit for vapor transactions is entirely nebulous. It seems the Thai officials would rather control the situation for persons doing online transactions while living in Thailand by control of visas/extensions of stay rather than perusing transactions made in the ether.

    Much like the US could not prove Al Capone ordered persons to be murdered; they busted him on tax evasion charges.

    The thing is, there's no rational reason for that, Unless the seller is actually promoting in Thailand (which would be work, IN Thailand) those people are going to download those books anyway, and so once more there's no net loss to Thailand, there's a net gain. I'm not really going against what you're saying, it's just one of those things that when you look into it, it doesn't really make sense if it were actually enforced.

    Which is why the Labor Department people don't seem to have any interest in going after persons living in Thailand and working online because the thing has become so nebulous -- they have tacitly decided it seems to leave such problems to the Min Foreign Affairs and Immigration folks since such persons living in Thailand and working online will eventually have to come before those authorities in person for their ability to remain in Thailand.

    This is another total misnomer your just trying to interpret the situation to support your "opinion" there are as far as I know no cases of people being refused a visa due to on line activities. The visa situation has been overblown by TV's doom and gloomers the only changes are to visa exempt extensions (visa runs) and tighter checks on ED visa's, tourist visas are still available with no official mention of how many can be obtained.

    You’ve been desperately trying to find some avenue to link your opinion to the objectives of the Thai government, as yet you’ve found nothing more than your interpretation of why they may or may not have done things. As far as I know the NCPO don’t run their policies past you so you have no insight in to their reasoning.

  3. I am not an attorney in Thailand, but I was an employment attorney in the U.S. for many years. I have lived in Thailand for four years now. This is my best understanding of the rules:

    Scenario 1. You are employed by a foreign company (or are self-employed in a foreign country), and you happen to be performing your work while in Thailand. So long as your work is not engaged in commerce in Thailand, and so long as your activities in Thailand are not the subject of your work in a manner that engages thai commerce, you are not working in Thailand such that you must have a work permit. Your business is registered outside thailand, your taxes are paid outside thailand, your money is earned for work which does not concern Thailand, and no profits are earned from thai customers or customers who elicit your services because you are in Thailand.

    Think of it as long holiday telecommuting. It is not illegal to telecommute from Thailand while you are on long holiday from home.

    In this case, you can be here on a tourist visa, and as such you cannot live full time in thailand. You also can probably be here on a retirement visa and still virtually perform work back home, so long as the financial source of your income is outside thailand, and paid to an account that is outside Thailand. The retirement visa would be more of a "don't ask, don't tell" gray area.

    Scenario 2: You work for a company that does business in Thailand, and your work for that business involves Thai commerce, and you perform your work in Thailand. In this case, you need your company to sponsor you for a work permit in Thailand.

    Scenario 3: You start a business in or move an existing businesses' operations to Thailand. You do not have a business entity registered in another country, you do not pay corporate taxes in another country, and you perform all work for which you earn money in Thailand. In this case, you need to set up a Thai company, have a minimum of 4 thai employees, and obtain a work permit --- even if your customers are outside of Thailand.

    Depending on how you arrange your affairs, self publishing via Amazon could arguably fit into any of these three scenarios. If you book is about Canadian fall flowers, and all you do in Thailand is sit beachside to do online research, writing and editing, then you are probably in Scenario 1. On the other hand, if you are here writing travel guides about Patong nightlife and self publishing them on Amazon, that is likely Scenario 3. If you are employed by Amazon to write books that in some way connect to Thailand or are sold to customers in Thailand, then that's likely scenario 2.

    In short - the answer most likely depends on what you actually plan to do, and how you plan to do it. Best course would be to consult a Thai attorney to get expert advice.

    That's probably the clearest and best informed answer I've seen on this often raised subject, working on line covers such a wide array of activities and circumstances the only way to get a clear answer would be to get advice from a Thai attorney.

    There is probably a good reason that this topic keeps getting raised and that's because every time it pops up JL and Co jump on it and it descends into completely uninformative irrelevant prattle, these guys are "experts" on everything from why the Thai government doesn't do things, to the detrimental effects that someone writing an e-book will have on the Thai governments stated objectives on crab fishing.

    You may think its the best, because its what you want to hear.. However the superintendant of Phuket immigration was 100% clear.. As was the officer at the dept of employment.

    The question was for online activity not in any way connected to Thailand.. Both answered you need a non imm visa and associated work permit..

    This isnt grey or out to debate.. You can choose to break the law, but they have stated clearly that the law applies.

    It's clearly the best response as it's an objective analysis that culminates in the sensible suggestion to contact a Thai attorney to find out the correct avenue pertaining to individual circumstances. This subject has been repeatedly debated on here you've got the regular ThaiVisa "experts" mob waving their pitchforks around who are categorically against people engaging in this activity, it's a strange use of time putting so much energy into debating an issue that has no relevance to their own circumstances.

  4. I'm no expert and couldn’t really guess over a ten year timeline so can only give guess based on a few factors. There has been a lot of foreign investment in Thailand over the last few years car manufacturing plants etc, that influx of foreign capital strengthened the bhat. That also coincided with quantitative easing and record low interest rates from the bank of England during the financial crisis which weakened the pound.

    Foreign investment in Thailand and other emerging markets is tailing off now that companies have taken advantage of the cheap liquidity, and the bank of England is eventually going to have to gradually start raising rates so the pound should gradually strengthen against the bhat.

  5. The person working on his own at Starbucks is helping himself; he is not adding to the the stated Thai objective of enhancing the Kingdom's capabilities in the IT / online services world. Some people seem to think their presence in Thailand as suggested above only has an upside and no downside.

    The person working on her own at Starbucks IS contributing to the Thai economy by bringing money into the country. A number of times on the thread I have asked people how the economic impact to Thailand differs for someone drawing on a trust fund offshore, and someone drawing on funds from a foreign business selling coconuts, and no one could answer...for good reason.

    Really the only negative impact from such a person would be if their PHYSICAL presence in Thailand deprived a Thai of some service, for example a bed for the night, etc. But, since the expat is also bringing money into Thailand, that claim in the real world doesn't really make sense.

    Wouldn't waste your time JL doesn't like people working online, he's got very little comprehension of the work people engage in but he's not the kind of guy to let that get in the way. He states he finds it annoying that these threads keep getting repeated yet still spends all day posting on them, that previous statement really sums it up. Of course the person working in starbucks (starbucks seriously who the hell would work out of starbucks) is doing to help themselves few people work for purely altruistic purposes, and of course the person writing an e-book, or whatever other activity isn't aiding the Thai government’s policy of enhancing in IT/online services because that in all likelihood has absolutely no relevance to the work he's engaging in.

The reason that the Thai authorities don't raid shared-office space, knock down condo doors, and deny more entries to the online folks on repeated tourist visas may be pretty simple: The component that such persons represent to the overall Thai economy is so small that they really don't give a sh*t. Most probably only do enough to get by anyway.

    Thai officialdom wants IT and online service companies to invest in Thailand and hire Thai university graduates and, I presume, as long as they do not provide incentives to the lone wolves who do neither, the potential investors really don't care.

    As for the repeated tourist visas, regardless of WP status, you sign a declaration on your application that your trip is for pleasure purposes only which, if otherwise, is making a false statement to a Thai official which may be an offense under the Thai Penal code.

    JL is there really any point continually discussing this subject if your best conclusion is that the Thai authorities "don't give a shit"? Though their lack of action certainly doesn't imply tacit approval, the fact is there is no official information from which to draw any conclusion. Since we can't really clarify the Thai authorities views on the subject we're just arguing semantics and opinion.

    As you say the effect on the Thai economy is pretty much zero and most are quite happily “getting by” and enjoying their stay in Thailand. The sheer scope of niches, skill levels, and fields of work people utilize really makes it difficult to quantify these people as a definitive group as the only link is they use the internet. No one is disputing the wealth of tech talent produced by Thai universities, but no one is competing for work with these guys.

    Is there a point discussing this? Yes. Because guys continually continually come on here and ask, since they believe they make such a significant contribution to Thai economy and culture, why are they not better accommodated by the regulations for immigration and working situation. The answer I gave to which you referenced still stands.

    BTW the views of the Thai officialdom regarding the advancement of the IT sector is quite well documented particularly on the BOI website and I make inferences from that.

    Because of the name ThaiVisa people assume this forum to be a source of information so obviously new people will sign up and ask for opinions on the same subjects, your under no obligation to read those threads if they cause you such umbrance. The fact is though that the same guys jump on these threads and hostilely espoused their opinion and it in veritably turns pointlessly argumentative and negates any possibility for intelligent discussion. I didn't see anything wrong with the OP's initial post yet look how quickly this devolved.

    To the admin I say, I will likely not be back. I find the general attitude here by many posters trollish and hectoring, akin to schoolyard bullies. It does NOT seem like a friendly environment for people seeking advice on moving to Thailand, which is why I posted here. By all means please monitor the thread and see for yourself.     This subjects been raised a few times and it gets the TV resident trolls excited as for some bizarre reason they really resent the fact people can earn a living on line. Basically they're just posting their opinion and using their vast (non-existent) knowledge of Thai law to attempt to substantiate that opinion, yet they consistently fail to provide any information from Thai governance pertaining to the subject. They're well practiced arguing this subject as they spend all day everyday loitering on this forum cluttering up various threads with inane rubbish, so if there was an relevant information out there that backed up their "opinion" they would have found it.

    When I obtained my last visa I was asked a few questions due to the amount of tourist visa's in my passport they were concerned that I might be working in Thailand, I told them I work on line and draw an income from my home country, they wanted to see statements to support this once they'd viewed the statements and seen the money was getting paid into my UK bank they gave me a visa.

    If the Thai authorities shared the view of ThaiVisa's arse clown brigade then I'm sure there would be raids on co-working spaces, several websites run by expats would be closed down and there would be at least some anecdotal evidence of people being arrested and fined.

    Do you have any idea whether it is possible to open a UK based bank account from Thailand? Working online interests me, although I currently work in an office, and I had not thought of this aspect, i.e. having money paid to you offshore to show that you are being paid overseas.

    The idea of retirement horrifies me, and working online appears to be an interesting option. Although god only knows what I would do online to make any money. Suggestions anyone, apart from online surveys.

    I'm not sure about opening a UK account from abroad, but citybank offer an international account that can be opened on line, the staff at the embassy wanted to see that I was drawing an income from outside of Thailand.

    There is a host of information on line reference earning money online there maybe something that fits your skill set, it's got to be a better utilistion of time than the guys who spend most of their day on TV arguing.

    China also has lots of paper gold in addition to huge amounts of physical gold. Less than one percent of all "gold" is physical and most of it is not for sale like the German gold at the FED. whistling.gif

    I wouldn't place to much importance to any MA's they're literally just the average of price over the previous number of periods, golds recent rise was due to geopolital tentions in the Ukraine and it's fading already. If your long gold you will make money eventually but I can't see anything giving it legs in the near term so I personally wouldn't use anything leveraged.

  10. I find the persistent idea in this thread that people like this overstayer (who was quickly let back in) played a major role in these crackdowns absolutely ridiculous. It is absolutely laughable that people believe this notion - it's clearly not the case.

    The OP did indeed make a conscious choice, a choice which disregarded any responsibility he may have had for anyone else who he may have been close too. You suggest that he made his choice to break several laws due to the state of Thailand's roads? What a nonsense argument from someone who apparently condones his behaviour. If he was on the correct visa with a work permit monthly runs would not be necessary, would they?

    I love it! Just get a work permit and the right visa. Again, plain disregard for people who don't have a 'regular' situation of a job in Thailand, ignoring some of the good comments in this thread about people who may earn money through different means that do not break the law. Or indeed, as when I moved to Thailand (like I said above) having plenty of money in the bank. They DON'T give work permits and visas for money in the bank.

    If the 'laws' (again, laughable they're called this when money usually circumvents them - seems the only idiots are those who bust their guts trying desperately to stay legal) here weren't outdated then people wouldn't be doing things like this.

    Agree, completely. Also, the endlessly repeated meme that an overstayer, or even some English teacher without WP somewhere, are 'destroying' Thailand, amounts to hysteria (more likely, an excuse to assume the worst about strangers).

    Firsly, there are NO system social services in Thailand (like there are in the UK EU or US) for a foreigner to 'take advantage' of. So really, someone could overstay for years and never take a single thing away from anyone else! Even if they wanted to. Someone overstaying doesn't mean they have free rent, or free food, or anything free at all. Not having the right visa isn't great. But it's hardly 'destroying' Thailand. If someone is truly a violent criminal or something that is completely different.

    Secondly, Thailand's unemployment numbers are as low as unemployment can be. Far lower unemployment numbers than most anywhere else in the world at this time. If some person is teaching English without a WP, there's no line of 'poor, hardworking Thai people' behind that person who were 'kept away' from that job. So that doesn't even make any sense.

    I mean, if Thailand wants to crack down in nonsensical, nationalistic ways about these ideas, that really is their right. And I respect Thailand, a lot -even if that doesn't include every extremist faction to come along at each turn. But that posters here take it on SO personally, as if their eyes were burning red with rage - this is just unhealthy on their parts. Thai culture doesn't even respect it when people behave that way, so really, it kind of just shows who has or has not appreciated the culture they claim to be a part of.   11. I think the Thai people and authorities have opinions about the foreigners living here that nothing will change. Some will always hate us, some will always like us and some don't care if we are here. When our actions don't have a real effect on them, they won't care if somebody overstays their welcome. And if you do everything within Thai laws, how can it matter what other expats or foreigners do? maybe their bad actions even make you look better for being good and doing everything the Thai government tells you to do.

    I read in this forum before i signed up to ask 1 question and I could see that many people love only to insult and make bad remarks here. I said to myself that I would not post comments here because almost all topics here turn into just silly remarks and nasty behaviour. So i guess I should thank you for reminding me to only get information here. It seems there are very many angry people on this forum who need reactions from other people. It's strange.

    I started reading more often because I was unsure of the visa situation and wanted to clarify the details in order to conform to any rule changes. What I found were cretins filled with their own sense of self importance literally jumping up and down with glee cluttering every thread with misinformation whilst chanting "go home" "unwanted" "shut the door on your way out" etc etc.

    If it wasn’t fro the quality factually based input from guys like UbonJoe then this forum would be useless as a source of information, so a big thanks to UbonJoe for dispelling the rumors and the information and advice he's provided.

    Chivas this is the clemency period so we can't criticize people for clearing up their overstays before the end of the month.

    However there will be the crackdown of all crackdowns next month and the wailing and crying will be so loud you'll be able to hear it in Malaysia.

    On a personal level though I'm in full agreement with you.

    This entire process is working as intended. The Thai authorities issued stern warnings and then gave people a couple of months to clear up their situation. I think their actions have actually been kind and humane. In response, people on overstay are taking them up on the opportunity to clear their situation--which is good for everybody all around. So far, good for Thailand and good for the overstayers who are now legal.

    It would seems the situation is less stringent than it initially appeared, they've eliminated the back to back visa exempt runs and are ensuring those on ED visa's actually are studying and those on tourist visas to show proof they can support themselves but they haven’t closed any options.

I suppose a person could argue that FDI is the new norm, alternatively it might be argued that if interest rates in the West were at their long term average, there would be very little FDI. I think I'll put my money on the fact that debt levels in Thailand are far lower than in the West hence FDI is the new paragdim.

    Right - But what I was actually questioning was the baht's exchange rate before the FDI. Was the baht overvalued before ?. Right again on interest rates in U.S. and FDI.

    In the big picture in my opinion it was Bush's deregulation in favor of the financial sector and that hack Greenspan lowering interest rates that have the baht/dollar exchange rate where it is today.

    The big question surrounding the Baht has always been, what is fair value against USD. It's clear that its value has been distorted since the Fed's QE program started and since we don't know the extent of FDI prior to that program, it's difficult to understand where any base line might lay. And since countries can attract FDI almost at will, the value of any currency is unlikely to reflect the underlying strength of its economy.

    Case in point, BOT issued USD 2 billion of bonds last week and they were all snapped up by overseas institutional investors in less than twenty minutes, a yield of 4%+ on offer! The impact of that venture strengthened THB since by nearly two baht. Ditto the UK where FDI has pushed the Pound to almost harmful levels, that value is no way reflects accurately the state of the UK economy. So in this globalized low interest rate age, FDI can be a game changer when it comes to exchange rates, trying to figure out what the values should be without any is an almost impossible task any more.

    The Bhat has been strengthened by the increase of foreign investment in the manufacturing industry partially due to cheap liquidity caused by QE, that investment is starting to tail off now. The market was anticipating rate rises from the UK and US but that's been curtailed by a dovish Yellen and the BOE's Mark Carney basically put paid to the idea of a rate rise this year from the UK today which accounts for the drop off in the pound.

    They ducked and dived, abused the the system in there place of origin, then came to Thailand to abuse the relaxed way of life and live n let live attitude of the Thai people, they made the mistake of mistaking kindness and tolerance for weakness, now they are feeling the result of their abuse of the Thai system.

    Get legal, or get out, respect for your host, nothing more is expected, nor demanded, nothing unreasonable, just live by the rules of the land YOU CHOSE to live in........yyeeaaahhhhhhh.

    Either satire being taken seriously by some or miserable interfering gits seeking to mess up other peoples live for their own amusement.

  18. If you know anyone who is on overstay or engaged in criminal activity why not go to the relevant Thai law enforcement agency and report them? Or is it that you don't think the Thai authorities are up to the job? Or maybe it just suits your unfounded sense of self importance that you should have special consideration from the Thai government and have visa waivers created for you?

     

    When the on liners suggested creating a visa to cater to their needs you were dead against that, yet know you feel that visa laws can be changed to suit your need seriously your hypocrisy knows no bounds. Why not put some time and energy into enjoying the country you live in, maybe go out into the big wide world and make some real friends you may possibly learn some social skills. Is it really the best use of your time is spending all day being belligerent on an internet forum?
