The rule concerning remitted income (not savings) has been in effect for many years, and I have been filing for that reason.

The Thai-US tax treaty does not contain the re-sourcing provisions of US treaties with many other countries, so it is not possible to make remittances to Thailand appear as foreign income when preparing Form 1116 on the US tax return. The result is that the only option is to get a tax credit on the Thai tax return for taxes paid to the US. The result may be that tax due Thailand will be zero.

Maybe Immigration will need a bed photo to determine whether the Thai is on top, in which case no 400K will be required.

The point is that if there is a joint income, then the Thai tax dept might interpret a transfer to spouse from abroad as part of the joint income. Better to check with a tax expert.

IT means inheritance tax, I guess. It depends on which is your home country. The exemption in the US for now is $11mn (lifetime and at death). I believe that Thailand has a large exemption as well (Baht20mn per year), and the rate above that is 5%. So presumably one can wire the gift to the spouse's account in Thailand, but if only joint tax returns are permitted, wouldn't that still be a problem?

For male couples, having their own children would involve surrogacy. Isn't that prohibited here?

I seem to remember that a usufruct is more stable if the owner and the holder of the usufruct are not married.
