Thailand to tax residents’ foreign income irrespective of remittance
Presnock replied to snoop1130's topic in Thailand News
That is one of the things being asked regularly - WE STILL have not been advised by the Revenue Department of alll that goes with this new interpretation. We are being told by "experts" that once we are tax residents, in 2025 if we have assessable remittances into Thailand then we need to have a Thai ID tax number and then need to file tax forms...however, if one with a US govt pension only like I do, then I will never be remitting assessable monies into Thailand so should not have to obtain a Thai tax ID number nor should I ever file Thai tax forms. Now, if they amend the law to state that once one becomes a Thai tax resident, they must obtain a tax ID number - then they need to amend their law on that and advise the expat community that this is a "new" requirement. Or, they could look at the amount I send and if that amount is higher than what they consider "of interest", they also might advise me that I need to visit the RD in my area and explain WHY I haven't obtained a tax id nor why I did not file a tax form here. Whatever they are planning (if at all) then it would sure let a lot of people just relax and get on with life either here or elsewhere if they would publish the new amendments to the tax law and what all it entails as of 2024/2025 timeframe. Good luck to all of us. -
Unless there is some kind of change, I find it difficult for banks to deduct any taxes until one is definitely declared as a Tax Resident. Prior to the 180 day (this year 27 June), if one had been in country the entire 180 days, year he would be a tax resident but unless the banks know exactly how many days one has been here during the year, they could not know one is a tax resident unless immigration and the revenue department start seeing ALL the ins and outs of expats - seems to be a job much larger than either could handle easily so in my opinion, banks won't be involved in the tax issue other than through the OECD, CRS, FACTA exchanges. I don't know how any of these interact with the Thais - through the Revenue Department, banks or what? Anyone have a clue? not me so I just don't think they could handle it anytime soon. I do hope all excape being caught up in this program needlessly.

sorry you don't like the tone but, we have advised people of this law about obtaining a thai tax id for 6 months. If you doubted our input then you could have checked a long time ago. Seems we have to repeat over and over for folks who read this forum. I didn't mean to upset you nor belittle you but, you said you have never heard of this before but you are an "advanced member" so I figured you read the forum messages regularly.
-
sorry you don'tknow how to look for information readily available. I don't link. You can find this particular LAW at the Revenue Dept Tax Knowledge and Code/Tax info just google: rd.go.th/english/21987.html that should do it....good luck info is easy enough to find on this issue. then read under tax identification rule #1 - states exactly that - within 60 days...
-
where is the change to the tax law on obtaining a Thai Tax Number - law I read says within 60 days of having ASSESSABLE income remitted into Thailand - some of us have not and will not have assessable income remitted into Thailand ever. Same as having to have to Thai ID to obtain the Taxation Number. Where did this information come from? Please advise via this forum. thanks in advance for the info.

probably said that the cards used must be from a foreign bank and that payment for the account had to be paid to the bank and not paid to a Thai bank. This is what several "experts" have said but then again, just as we keep saying, we have to wait to see what the Thai Revenue Department will be ABLE to do in accessing the information from one's bank or if there will not be charges levied against this type of activity.

Phuket Immigration Crackdown: Four Foreign Nationals Arrested
Presnock replied to webfact's topic in Phuket News
WOW! First time on this forum or anywhere else that I have seen this happen. Thanks for advising me that sometimes immigration does get it right! But too many times to count plus my own experience with landlords to get them to actually do the TM.30 even though it is online for them easily in my opinion. I have offered but then the landlords won't give me a copy of the necessary documents to do it myself. -

Seems to me that this is a perfect example of the Immigration Bureau mismanagement of the TM.30 requirements. As stated in this article on the arrests of the 4 foreign overstayers, it is reported that the immigration office in Phuket has "issued a stringent warning to accommodation providers" while many immigration offices may do the same, it seems we only hear about the expats who have to pay a fine for not filing a TM.30 or landlords that fail to provide necessary documents if they refuse to do the TM.30 themselves as required. These landlords we never hear were fined or anything else but many expats have seeminly had immigration problems for not filing a (landlord) required TM.30. Just saying...good luck to all. -
That is exactly what the shoppers are complaining about in the states - after COVID in which businesses had to close, then inflation hit and all the businesses jacked up prices from fast foods, gasoline, restaurants, grocercy stores, et al.....now a coupld of year later, the prices are still jacked up and the businesses don't understand why no one is coming into the business nor buying anything.

Thailand to tax residents’ foreign income irrespective of remittance
Presnock replied to snoop1130's topic in Thailand News
Well IMHO now, once they decide to notify the nation of the implementation rules for this (first phase of taxation), and then 2025 rolls around and we don't really know more on how the Thai revenue dept will be operating. They will most likely do that bit about having each person decide if they need a tax number (or they will amend he law to say that each tax resident must obtain a Thai tax id number) and then they will let us the expats either find an agent to assist them in filing the tax forms. Some will just ignore the RD until queried about the remittances and if one claims "exemption" then one must produce documentation supporting that. I think that there is no way they could open the gates to every Tom, Dick and Harry to start filing for a Tax ID number nor sending in online all the tax forms especially with so many different interpretations of every type of DTA, or remittances of so many different types of income. Seeing as how they have rolled out this first phase, so haphazardly, it will probably take years before they settle down as to ''Hm this doesn't work and we are losing money" until they come up with the next phase of worldwide income taxation. But that is BUT TIT so...good luck to all you Tax residents. -

Thailand Unveils Ambitious “Zero Dropout” Program
Presnock replied to webfact's topic in Thailand News
Making poor families buy uniforms for school which does not promote a better learning attitude according to all I have read over the years (sorry I can't link for non-googlers) could be a start on economics reason for some dropouts, plus a better curricula for all the schools. My daughter began schooling, kindergarten - my wife researched best schools (strong English learning) but all local schools - we tried several, then as she got older we kept going from school to school - again wife researching and schools with a good reputation for learning were our choices. One within a month of our daughter beginning and even had her picture on their advertising brochure, the school fired all the western foreigners and hired filipinos so on to the next school - had a 2-year waiting list but daughterf scored really high on their entrance test so they let us join that school - k-12 grades with lots of western foreign teachers...after 2 years, the school dropped grades 7-12, fired a lot of foreign teachers and expanded their Kindergaten to an extra 3 classes as they could charge more money for the K group as those classes needed 3 teachers vs two only. But they continued to drop western teachers and then I got tired of the ENGLISH taught by the Thai teacher (each class had a westerner and a Thai taught separately) where the lessons were not only poor English they were totally wrong. Thai teacher I spoke with in Thai - said that she was not allowed to change any of the lessons prepared by the school owner and head of school and that she was not allowed to correct any lesson with the western English teacher - so I met with the school owner - took examples of incorrect English lessons - she spent 20 minutes telling me how great she was, her schooling background, etc and said that ALL the lessons were correct and would not be changed! FIne, on to the next school - a Sathit (luniversity) school - brand new building etc new teachers etc but we left after the first year, school offered a full scholarship for my daughter to stay there but within two more years none of the foreign teachers remained at that school and only some of the kindergarten originals remained. No half Thai nor Thais about 1 st grade (the first year) remained. Jinally settled on and international school - refreshing to say the least. It is not on the list being circulated almost daily recently on this forum as one of the top 10 but it was as good or better than any US school. My daughter spent 5 years there, came out speaking, reading, writing and teaching experience in 4 different languages (Thai/English native, Korean level 4 tested, Chinese a year's teaching (11th grade) at another Thai HS and very high scores (AP classes in) Math and Computer Science. She is at the #1 University in Thailand and is doing GREAT! The local schools need to adopt teaching methods and curricula more aligned with the west (EU and US, Singapore) if they hope to bring better education to this country. My opinion as a non teacher of school kids but as a parent of two bright kids that excelled only because they opted out of local schools for international schools. -
If I am not mistaken, it has disappeared and has been replaced with "climate change".

Absolutely correct in how we must watch how we say exactly how we feel about some subjects here as we are not in our home countries and some folks have weak tolerances for the truth. Have a good one! -
which causes more evaporation of waters which in turn return to earth in record amounts resulting in floods. Then other areas become drought stricken, rivers and lakes dry up, forest fires result then when it does rain, landslides and mud floods a never ending battle. Now with record temperatures in the south/central Atlantic, Mexico, northern S. America and the US will experience some really strong hurrricanes - i.e. a record setter for the very first one of this season. Just look at the world news daily - i.e. The US upper central area super floods, Fla, floods, Texas floods, too many tornadoes this year, fires in Calf and N. Mexico, "Gorilla hail" size of softballs in many states, floods in China, India, Pakistan, Kajikistan, Brazil, Peru, Kenya, Switzerland, Italy, Germany, record HEAT in US, India, PI, Thailand, France, Spain, and others. US advising folks to buy EV to cut pollution while they advise folks to turn their A/C much higher or off as there is not enough electricity being generated by all the A/C's. Just a few comments from the news of the last couple of days and I missed quite a bit too.

Thailand to tax residents’ foreign income irrespective of remittance
Presnock replied to snoop1130's topic in Thailand News
Yeah, it is so complicated to carry out and that probably is why nothing final has been published. They probably have as many different suggestions and solutions we have read here and elsewhere. -
Yeah, I can remember the first couple of times I went to HuaHin - the entire beach was EMPTY except for me and my wife and daughter. Could by a giant prawn for about a dollar at any restaurant there, then would drive back to BKK. That was in the mid-70's. Times have changed. Khao Yai used to have a super golf course - had guards 'cause some had seen a tiget or two. Rope bridges on some of the Par 3's, but then when I came back in the '90's the course was closed... hell of a lot more tourists than I ever thought about. The beaches and ultra clear waters in the PI are much more attractive to me. Golf courses are great anywhere in the world. One thing though the Thai food in almost all the restaurants is a lot cheaper than in the US at Thai restaurants. I remember going to the CM night market in the 70's and buying a carved elephant - must have weighed about 20 kilos strapped it so could carry it as a suitcase - taxi driver in BKK wanted me to sell it to him for double what I paid for it - gorgeous sittin in the states now. Lots of things have changed and some of the thrill of doing some of the things we used to do but a lot of that is the uniqueness of the whole picture here has changed as have the smiles and then of course I am an old man now and different things thrill me now, but I still love Thailand and hope to spend the rest of my days here. I was born in the USA but I have spent more time in Thailand than in the US. If I had to leave then I think I would go to the PI but I really don't think that will ever happen.

New "Income" tax law 2024
Presnock replied to Tom Vanderlay's topic in Jobs, Economy, Banking, Business, Investments
B4, I saw a lot of youtube videos on the different tax proposals, then on agents looking for business, now I see folks advising prospective retirees to go to Malaysian, the PI or Cambodia if one wants to remain in the area and still get a tax break. I really don't know for sure but from these new videos, those countries are not going after expats like here seems to be doing. Good luck -
New "Income" tax law 2024
Presnock replied to Tom Vanderlay's topic in Jobs, Economy, Banking, Business, Investments
Actually I too have been doing the FBAR every year - although previously I didn't meet all the necessary criteria as I didn't have 10K USD in my acct here in any one month - But as I always did he FBAR just to be safe, now that daughter is in college (tuition) here and we rented a condo for her by the college, plus also rented a house in BKK because we have two dogs and needed a yard, then at time I have had 10K in one month or more so doing the FBAR just comes naturally. I send mine in the first week of January every year. I started doing them whenever they came out with the requirement just to be safe, sorta like taxes - I send mine in as soon as I get the 1099R from the government. If Thailand were to tax me on my US govt pension (which they can't due to DTA and current LTR), and actually took monies out of that which remitted or tried to do so later, they according to US tax laws, it states that I could then decrease my US tax bill dollar for dollar. i.e. the Thais take out 1000 USD for taxes, then I could claim that when I filed my taxes. The 2023 instructions claim Publication 514 (2023) Foreign Tax Credit or the instructions say one could also use form 1116 foreign tax credit and claim it as a deduction on the 1040. I suggest if you normally can do your own taxes without problems, that you google the Foreign Tax Credit, see what forms or whatever one can use currently, then check on the IRS website for those publications or forms, check to see if you fully understand them. If not, then there are numerous agents overseas in most major cities that have tax "expert" who will help you or you can ask specific questions. My finances are basic only and really simple so I have never had any problems following the IRS instructions. Good luck as I find most of the instructions with the forms to be pretty comprehensive and easy to understand. -

I have no clue about agents but seeing as how they seem to have contacts within immigration it might be that agents share charges paid by the expats. But like I said, maybe immigration just sees agents as easier to get along with...555 -
