I said nothing of fault, clearly the driver is at fault. My concern is with liability, it is completely different. If liability is with the company renting the vehicle (as it most always is in the west), the rental company is responsible for making the victim whole and collecting from their customer, the driver/renter. You can't get blood from a turnip.

Because I think the people participating in the behaviors should pay for the results of the behavior. Right now, if some bone-head rents a motorcycle and runs me down on the sidewalk, I would be liable for my medical bills, and my taxes will ultimately pay for bone-head's medical bills.

It is only obvious to people that do not think things through. When six people buy insurance, only six people are covered. When 100 people buy insurance, 100 people have to be covered. The people already buying insurance generally have assets they stand to lose. The people that go without insurance, often do not. Right now, you pay the money and get the travel insurance. You (apparently) want to compel people to provide a lot of personal information that the insurance company has to verify, which would take weeks and add cost.

I think the easiest/best thing to do is to make the rental companies liable.

To a lot of people, it is pretty black and white. The side that in intentionally targeting civilians is evil and needs to be eradicated. The only people that see a lot of grey, are the people claiming the intentional targeting of civilians is justified.
