I am sorry to bring you very bad news. Although you say you found it. You were at an airport where bags are all around. You made no attempt to give the bag to airport officials and you then attempted to leave the country with the items. In the criminal code it is theft. Your lawyer has misinformed you. Even if you paid 40000 baht and she dropped the charge, you have committed an offence under the criminal code 334 for theft. The sentence is up to 3 years and up to 6000 baht fine.

But you also are in section 335  (9)that the offence was in an airport, with sentence of 1 to 5 years. But if your offence is at an airport  (9) and at night  (1) the sentence is 1 to 7 years. So the least you should expect and prepare for is 1 year in prison. If you are very lucky the judge will give you a suspended sentence, however that will most likely depend on your plea. If you go to court with remorse and deep apologies and admission of guilt, then you save the court time and he most likely will give a suspended sentence.

If you go to court lying that you found it and didn't know it was theft  (at an airport ) as you are trying to do on thaivisa. The judge might decide that you need a stronger lesson about your wrongdoing and give you the one year.

Judges know truth from lies and we all aren't as stupid as you think.

Your best defence is to admit your guilt of theft, apologise very very much and show the judge you are truly sorry.

But it seems that people sometimes do not even meet the judge ? (they are just waiting the decision in another room) So how to apologize ?!

A common cause for accidents in Thailand, is the fact that people in the car do not know the use of an aircon, and keep the switch in the position as shown, therefore getting tired or even fall asleep behind the wheel due to the lack of oxygen.

German cars and maybe any decent car turns this off automatically for you after 10 mns...

much better to make the so called driving test harder, should include a theoretical test of MANY questions of which a great percentage must be answered correctly IF NOT then the person does NOT pass

so 90% will just pay someone to get the license without test.

strop dreaming, it's clearly impossible that anything changes, and it's ok this way, because it's usually not me who dies :-)

But why do Thai people don't want to do the jobs?

Might it be the very low pay, maybe?

For example, a friend got herself a job in restoring a factory building.

7 days a week, daily from 5 in the morning till 18, one hour lunchtime.

Daily payment 300 baht, minus 50 baht for drinking water.

I will not bother you with all the deductions meted out for whatever reasons, but it boiled down to 12 hours per day for 210 baht.

It seems quite impossible except if you have "friends" that are too stupid to accept this and who cannot find any other job correctly paid.

There seems to be an understanding here that the minimum wage 300THB must be paid, in reality in the real world it isn't,apart from Homepro 7/11 Makro etc

Wifes daughter  came down to Prachuap applied for hotel job(private Thai hotel room rate 2500 plus per night) daily rate 260/280 per day.

Around here the guys would rather do nothing and drink lao cao or beer all day on money from wife family etc rather than work.

Also I am pretty sure the local farming mob around here do not pay 300THB a day maybe they get around it by coercing family members

This is clearly the real truth, but it is also true that staff do not stay.

I see a lot of posts here are selfish or unselfish? It confuses me. I think having kids is a purely personal decision, one that has nothing to do with selfishness. If you like kids, great if you don't... Also Great. I like kids, I enjoy my time with them, they are my best friends too. I understand not everyone will agree with that position and I accept it. I fail to understand why there would be any conflict.

    I don't like kids, I am not a pedo ?

i have a Merc AMG63 ML wagon, since new 2009, has been a good vehicle, some minor problems that go with age

    still running strong.

when i arrived in Phuket Mercedes dealer was useless... i even had to buy mine in Bangkok at an authorised Mercedes dealer as the sales people or whomever in Phuket would never return my call and when i arrived for a service they looked stunned...

there was an enormous language difficulty in the beginning when i pointed out items that needed repairing or replacing and many times i would turn up and the service was done but no repairs so the vehicle had to go back again, the thing that annoys me the most and its not just with Mercedes but also Honda and Ford, if you need a part they want a deposit and then they order stock from Bangkok, whereas we are use to having vehicles just fixed and when we collect we pay in total, they holding the vehicle so whats the problem. Ford didnt even have a brake bulb in stock for a Ford Ranger... i just laughed and walked out.... Honda oh we have to order battery from bangkok i just took car and went to the nearest battery shop and had one fitted for much less the cost.

Mercedes have improved alot, maybe because more and more mercs are sold and in Phuket, the language has become much better and to make sure i write a list out and stick it to the inside of the window what needs to be done.... sofar so good.

Honda told me the other day my car was ready to be collected, i had a faulty brake switch under peddle which only cost thb300 but the vehicle was also booked in for a new Navigation screen as this one went faulty and cost about

25K, they ahd vehicle for a week called its ready to pick up.... arrived bill only thb300, whereas the invoice for navigation screen, then you get the cashier and girls doing the Thai Dance looking around at each other, obviously it was done, oh its coming then why did you call me, i had to take the vehicle as needed to collect my wife from hospital..... car was dirty and filthy when they gave it back to me as it must have been sitting out the back all week not even a quick wash down... i took it back 2 days later at 9.00am told them i will go to central for breakfast and shopping and will return 1200 please make sure its ready and invocie ready. arrived back all done, but cannot process as cashier back from lunch 1.30 so i had to sit and wait... anyway this is thailand.....

No problem in BKK except that the idiot there told me that I couldn't put the S-class in my name because I didn't have a work permit 555. What a team of retarded, this is why I do not stay at fiver stars hotels, too many idiots working there compare to EU or US.

    Hello,

first off all I need to thanks the some people here, who have listened me, give me some comfort words and free advices.

i have been on court at 21 August, and the judge give me the sentence I know. NOT GUILTY.

    As I have told,

i have found one bag, don’t still the bag to any one. The judge have comprehension and give me a 30.000 bath fine and release me of all the charges.

im in freedom not on the IDC, because my lawyer garante me, and I have to stay In Thailand for one more month, because the public prosecutor could contest the judge decision.

I don’t know if possible put my lawyer name and contact here, but if someone need could send me a pm.

the lawyer is not cheap, but a honest and decent guy.

im here alone, and the lawyer knows that, so every day invite me to lunch or dinner In is house, with is family, always worry if I need something.

in the prison have 2 guys who help me a lot, and because I don’t have my passport yet I can’t visit then.

the lawyer arrange the things, and put me like is employee/ translator and Monday ill visit and bring food for the people who help inside the prison.

maybe it’s important say, the lawyer, now a friend of mine is the Vice President of the Thailand lawyers Association

Thanks everybody for your help and kindness words

    Thank you for the feedback.

So the judge was not totally retarded as the rest of the people here and even if he decided that you are guilty, he knows that it's stupid to send you to jail for such a small case.

If not guilty you would have nothing to pay.

As I've understood it, EMS is simply the international collective/network of different countries' national postal services. So in Thailand that's Thai Post. In the U.S., that's USPS, although they don't use that name in the states.  But when you send an EMS package from Thailand to the U.S., it gets delivered by USPS.

Not always. USPS has many subcontractors now, depending on the location.

But yes, it goes through USPS as most post offices in the world, because EMS is the express service of public posts.

Agree, in reality the amount they allow is higher, I'm sure it all depends on the postage type, if you use postage with insurance you are giving them a value so it is processed in a different way at BKK airport. I try to get suppliers to post with no insurance, not all are willing as they may be responsible for losses, as I said i have only lost one parcel so this method has worked out far cheaper. As to the future? who knows but the shear volume of parcels arriving in Thailand, which is only going to increase, must be making them think they should be getting more revenue, thankfully Ali express and others have a fair bit of political clout, long may they reign!

In the future ? nothing will change, because they will never have enough tax to check more than 5% of any parcels coming from abroad.

Only robots could do it but it's not really possible, at least not before a very very long time.

Most of the goods I buy come from on-line shopping, cheaper, easier and far more choice. If the goods are less than~$80 they will never tax them, goods over that value its hit and miss, the more expensive postage you pay for from overseas the more chance you have of paying taxes, even with taxes the goods work out far cheaper than buying "local" the cartels have the local market well under their control!

Never use DHL, you will pay taxes every-time, they have some sort of deal going with customs, use UPS at your peril, though not as bad as DHL. Best is USPS parcel post, rarely do they bother to tax, the more expensive options they do tax more often than not. Royal mail from the UK is another they rarely bother to tax.

Using the cheaper rated post services is far more cost effective, my success rate has been 99%, even with the one parcel I have lost, money was refunded.

The deal is the same for ALL courriers companies.

They are allowed to deliver faster because they tax items on customs behalf.

The only reason why DHL is more of a problem is that it's the smallest company in most countries, so they have a lot of time to inspect and tax ALL parcels.
