Jamie Foxx aside, there is an incongruity in that few if any one-off cases under the NY State law do not give a date so that the defendant is at least allowed the possibility of entering an alibi. In a criminal case, absolutely. In a civil case, that will be decided among other constitutional issues. But again, in most if not all one off cases, a date on-or-about was provided
  3. That's what will be the case presented. Most of the NY State sexual cases involve assault that occurred over a period of time usually involving some form of employment and most, if not all, the other one-off cases have a specific on-or-about date as with the Oscar-winner Jamie Foxx case above.

  8. I just look at the case docket in both the civil and criminal trials. And I voted against Trump twice already.
  9. He was denied the right to an alibi because there was no claim by the Plaintiff as to the actual date when the alleged assault ever took place. The current trial as defamation-only was originally filed in 2020. The trial where Trump was found liable for assault was filed in 2022 when NY state gave a temporary reprieve on civil sexual assault statute of limitations. That is the case that is now under appeal. And when the current 2020 so-called Carroll 1 case is resolved, that too will likely be appealed after posted a bond or cash.
  10. The second case is actually the first case. You are right . No Alibi. How can there be an alibi when Trump doesn't know on which day the alleged assault occurred?
  11. His guilt, or more accurately liability, was settled in Judge Kaplan's Federal District Court. Not yet in the Court of Appeals for the Second Circuit. Personally, as someone who lived in NY City in the mid-1970's when Donald Trump from Queens was becoming, The Donald' I would go with the Al Pacino quote from And Justice For All: That man, there, that man is a slime! But, to me, denying someone the right to an alibi in a procedure like this, when there is an one-off incident involved, whether criminal or civil, should not stand.
  12. It was on the court docket post jury decision. And her suggestion I would say is more that there was always a clinging sales associate present than in actual security. And while I might offer my opinion as to why, I think maybe sometime during an appeal this may be at issue civil trial or not: Her: You raped me. Him: When did I rape you? Her: I don't know.

  16. From a today NY Times Letter to the Editor (trust me): The Iowa results were not great for those who would prefer that Donald Trump not win the election. On the other hand, 49 percent of the caucus voters did not vote for him. The weather was extreme. One may want to think that Mr. Trump’s great fans showed up in a higher percentage.

  18. Yes. I saw your comment above. But that all becomes a function of, not just what revenue does, but how any expat deals with or somehow avoids dealing with immigration.
  19. The big difference is that the locals don't have to deal with Immigration. Then again, some non-Thais, for one reason or another, don't either.

  22. Some do these things because their finances are otherwise not sufficient and some just do it for sport. Early on, I made the comment that -- without any Social Security or other DTA-type exemptions -- with only the deductions in the current Thai tax law, my tax bill might be about $US 100 per month. I wouldn't like it, but doable. And someone came on and rightly said that, even if that amount is no big deal for you, for some retired types already marginal, that 3000 or 4000 baht per month could make a big negative difference in their life.

Based mainly upon my observing the willingness of (American) expats to lie and cheat on their sworn US Embassy statements for extension of stay income affidavits (RIP) -- even when doing so would be a possible felony in the US -- it is my opinion regarding immigration and/or revenue matters that, if an expat feels he/she can cheat and get a away with it, they will.

  25. I will agree that, for any time soon, an ATM withdrawal in Thailand from a foreign bank will be non-traceable to an expat in Thailand. It will maybe come down to, if one ever files or has to file a Thai income tax form, are the amounts you actually claim as foreign remittances plausible.
