Judge confronts novel issues in whether to move Meadows’s Georgia charges to federal court 09/04/23 6:00 AM ET A judge is set to rule soon on the first Georgia 2020 election co-defendant’s attempt to move their charges to federal court, a decision that could prove decisive for the future of Fulton County, Ga., District Attorney Fani Willis’s (D) criminal case. Former Trump White House chief of staff Mark Meadows wants U.S. District Judge Steve Jones to allow him to switch courts to attempt to get his charges thrown out on immunity grounds. It would also widen the jury pool to less Democrat-heavy areas and likely prevent a televised trial allowed by state law. “A judge doesn’t ask for additional briefing unless the judge is thinking that that briefing will be helpful to resolving the motion that is in front of them. Singer-songwriter Jimmy Buffett had been fighting skin cancer for four years prior to his death, his official website has revealed. Buffett had Merkel Cell skin cancer. He died Friday at the age of 76 at his home in Sag Harbor, Long Island, surrounded by family, friends, and his dogs. His official cause of death has not been revealed. There has been one settled case since Jan. 6 that invoked the 14th Amendment. In September, a judge in New Mexico ordered a county commissioner convicted of participating in the Jan. 6 riot removed from office under the 14th Amendment. I will back off on fidelities for now. The Prosecution cannot call him as a witness. ********** And to amplify, if the defense were to voluntarily call Trump as a witness, then Trump would not be able to claim 5th amendment upon cross-examination. -

That may be true. But at some of those charged were government employees at the time of the charges so the question becomes were they performing an official function or was this gross political activity. And, at least according to the Meadows legal argument, it only takes one such acting in official capacity to move that individual's trial to Federal court. This is just a motion for venue. It is not the criminal trial. -

Per reading Meadows Motion, no matter how many charges there are, it only takes one decision that Meadows was performing in his official capacity to qualify for removal. And Raffsenperger is quoted as saying: Secretary Raffensperger confirmed Mr. Meadows’s limited role in the call (consistent with audio recording introduced into evidence), noting that Mr. Meadows “was acting on behalf of the President,” Tr. 219:14; making clear that he (Raffsenperger) did not believe Mr. Meadows’s participation or statements on the call were “inappropriate,” Tr. 220:16; and acknowledging that Mr. Meadows did not make any requests to change vote totals, So we'll see. -
