DEFAMATION LAWSUIT Daniels filed a 2018 defamation lawsuit against Trump in federal court over a Twitter post in which he accused her of a "con job" after she described being threatened over publicizing her account of the alleged sexual encounter. A Los Angeles-based federal judge decided in 2018 that Trump's remarks were not defamatory and were protected by the U.S. Constitution's First Amendment's guarantee of free speech. The judge's decision was upheld on appeal. The U.S. Supreme Court in 2021 declined to review the matter. Daniels has said an unknown man approached her and her infant daughter in 2011 in a Las Vegas parking lot and made threats after she agreed to talk in a media interview about her relationship with Trump. In 2018, Daniels released a sketch of the man. Trump responded on Twitter to the release of the sketch, writing: "A sketch years later about a nonexistent man. A total con job, playing the Fake News Media for Fools (but they know it)!" https://www.reuters.com/world/us/who-is-stormy-daniels-what-did-she-say-happened-with-trump-2024-02-15/

From APRIL 11, 2024 Then there’s another, less explored route that Trump’s team could try: asking the judge to give the jury the option of convicting him on lesser, misdemeanor offenses instead of the felony counts that have actually been brought by Manhattan District Attorney Alvin Bragg and his team of prosecutors. A person familiar with Trump’s legal strategy told me that some of Trump’s lawyers have quietly — albeit tentatively — considered that option in the run-up to the trial, which has not been previously reported. Trump’s attorneys did not respond to a request for comment. “Now, obviously he doesn’t want” to be convicted at all, the person familiar with Trump’s legal strategy said, “but a misdemeanor conviction in state court in Manhattan is going to have absolutely no effect on this guy’s ability to run for office or on his liberty.” https://www.politico.com/news/magazine/2024/04/11/trump-alvin-bragg-trial-win-00151558

Shake-down allegations and another contempt hearing highlight 10th day of Trump’s trial Prosecutors said Trump was creating an “air of menace.” Trump’s defense team suggested a key witness was an extortionist. 05/02/2024 08:55 PM EDT On the Hogan sex tape, Bove asked Davidson if he had been investigated for extortion by federal and state authorities. “That’s true,” he responded. The Trump attorney then pressed Davidson on whether he had familiarized himself with extortion law so that he wouldn’t break the law as he navigated the Daniels deal in 2016. “I had familiarized myself with the law. I’m a lawyer,” Davidson said. https://www.politico.com/news/2024/05/02/trump-hush-money-trial-day-10-00155912

Eric Trump maybe got approval from the Judge. * Trump is not on trial for extortion. But other than bookkeeping, the Prosecution still hasn't said what was the (an)other crime. * 6.03. Exclusion of Witnesses (1) Subject to subdivision two, a court may exclude a witness from a courtroom prior to the time the witness is anticipated to testify in that proceeding. https://nycourts.gov/JUDGES/evidence/6-WITNESSES/6.03_EXCLUSION OF WITNESSES.pdf

May 2, 2024 During the cross-examination, the defense lawyer Emil Bove quickly sought to discredit Mr. Davidson. He accused him of toeing the line between seeking monetary settlements for his clients and extortion. And he warned Mr. Davidson that he was “not here to play lawyer games,” adding that he was seeking truthful answers. https://www.nytimes.com/2024/05/02/nyregion/trump-trial-keith-davidson-stormy-daniels-hush-money.html **************************** Updated 2:12 AM GMT+7, May 3, 2024 (Emil) Bove also noted that Davidson had been involved in similar hush money payments for clients that had nothing to do with presidential politics, grilling him about previous instances in which he solicited money to suppress embarrassing stories, including one involving wrestler Hulk Hogan. By the time Davidson negotiated hush money payments for McDougal and Daniels, Bove asked Davidson whether he was “pretty well versed in coming right up to the line without committing extortion, right?” “I had familiarized myself with the law,” Davidson replied. https://apnews.com/article/hush-money-trial-new-fines-testimony-trump-fe6995afbc96650b67f46d813ab05f06 Quote

As someone who has a long-term family in Florida and myself for 20 years before moving to Thailand I would sure like to see Biden take Florida. But the nature of the elderly retired population in Florida is that their kids and grand kids often or mostly do not live in Florida. -
Published Apr 29, 2024 at 11:37 AM EDT Biden faces concerns among young voters, a crucial voting bloc for Democrats, ahead of the presidential election, according to a March poll that found former President Donald Trump winning voters younger than 30 years old. Political strategist James Carville has gone viral on social media after cursing young voters over their perceived lack of enthusiasm for incumbent President Joe Biden. "There will be no government left, there will be no rights left, you will live under theocracy, you'll end up with Christian Nationalism [if Donald Trump wins]," Carville said during a 12-minute video posted to the Politicon YouTube channel. "But that's all right you little [expletive] 26-year-old, you don't feel like the election is important." https://www.newsweek.com/james-carville-curses-young-democratic-voters-viral-video-1895185

That it turns out it is standard NY State criminal procedure as an 'expert' who is not familiar in detail with the facts of the case cannot offer any opinion on whether a crime has been committed. -

April 25, 2024 Shugerman (in NY Times) also emphasizes that there’s not even any other New York case that sustains the use of another jurisdiction’s statute – federal law in this case – as the “other crime” in. But, Shugerman writes, there’s “no previous case of any state prosecutor relying on the Federal Election Campaign Act either as a direct crime or a predicate crime.” That, he says, is a “sign of overreach.” https://www.salon.com/2024/04/25/underestimating-alvin-braggs-case-against-donald-is-a-historic-mistake/ While falsifying business records is often a misdemeanor charge under New York State Law, it rises to a felony when the falsification is done to facilitate “another crime.” It remains untested whether the statutory language of “another crime” applies to only state or also federal crimes. I like this oft stated rationale: The trial is not about paying a prostitute. It is about illegal book keeping to avoid impact on a political campaign. Instead of: The payments were made during a political campaign because that's when Stormy Daniels and her attorney decided to show up. -

The 9th US Circuit Court of Appeals sided with the former president in his effort to recoup additional legal fees from adult film star Stormy Daniels, who had filed and lost a defamation suit against him. Daniels was ordered to pay Trump’s attorneys just over $120,000 in legal fees. That’s on top of the more than $500,000 in court-ordered payments to Trump attorneys she’s already been ordered to pay. (Judge) Otero later ordered Daniels to pay roughly $293,000 in legal fees. She was also ordered to pay $245,000 in fees after losing another appeal. https://edition.cnn.com/2023/04/04/politics/stormy-daniels-pay-trump-legal-fees/index.html
