"To obtain the best protection under marital law, make sure the funds to buy the property and the actual purchase are transacted after marriage not before". I strongly disagree. Any contract entered into by man and wife during marriage can be voided upon divorce, including an usufruct. The usufruct must be entered into whilst the couple are both still single. -

The Thai Revenue is beginning to adopt international standards and conventions for taxation. The fact that may benefit them is a only a pointer to the fact that they have been so very lax in the past and allowed foreigners to get away with far too much, far too easily. -

Jim, thanks for the explanations but we're doing the very thing we said we wont do in this thread which is to post long explanations about what if's etc. I hope you wont be offended if I follow the practise I adopted from the outset and remove unnecessary posts, hopefully leaving the poster with his answer

I can't believe I've been here 20 years, time has just flown. I've never once wanted to move back to the UK. I did buy a flat there and was planning to spend a few months there each year but it wasn't me, now I just rent it out and collect the income. The UK i remember and love doesn't exist any longer. If I'd stayed I would have grown up with the changes but when you leave for 20 years and then try to go back, few things are the same. I've been an expat for 50 years. There was a time when I used to get excited about going back but I noticed that excitement wore off increasingly quickly, with each visit. Pretty soon it got to be the opposite, I used to dread the idea of returning and got really excited about coming back here. If you are seriously thinking about returning, go back for a visit at the worst time of the year when it's cold and damp and see how you like it.

Understood. Not wishing or intending to sidetrack the discussion but the need for both husband and wife to write wills is of key importance. Otherwise, as you correctly say, the combined burden of emotional strain from the death of a spouse and the pressure from greedy family members, can be overwhelming. -

The OP is considering buying what he calls a villa which we can safely presume is a house and not a condominium. It is also virtually unheard of for anyone to purchase a villa/house in Thailand, without there being some connection to the land on which it sits. I think it is fairly safe to assume that the OP is buying a home, along with the land that it sits on rather than having leased land and then building a home. I think we can also safely assume that the OP himself is supplying the funds for the purchase but that the property will be registered in another persons name, hence his desire to explore usufruct. Property laws in Thailand are national laws, the laws themselves do not vary by province but sometimes the local Land Office will apply their own slight variations regarding whether or not they will actually grant an usufruct. My Amphur in Chiang Mai will grant usufructs to foreigners. Lastly, when you post a material statement in quotes, will you please remember to provide a link to the source of the statement, otherwise remove the quotes. Thanks. -

Re. Point 2 & 3 - not so if the wife has written a Thai will and leaves the house to the husband. In that scenario, the husband inherits the property and has one year to sell it and the traditional hereditary chain is broken. -

The op is buying a villa, not a condo. Keep it factual and relevant please. I have an usufruct, our solicitor is one of the most highly regarded in the North and on all the Embassy lists, I believe she understands the function of an usufruct. -

It is not possibly for a foreigner to circumvent Thai property ownership laws by buying in joint names. An usufruct is not joint, an usufruct is granted to an individual. An usufruct gives the grantee the sole right to determine who has the right to live in the property, including the right of the grantor to live there. A superficies is very similar to the above but does not expire upon death and can be transferred and inherited.
