Although it does provide an interesting opportunity for a middle aged straight white male to move off the bottom tier in this multi tiered justice system, as long as he doesn't mind wearing a dress and a bit of lippy.

It is only necessary for ethnic minorities. In other words, all other things being equal it is necessary for a 40 year old black man but not necessary for a 40 year old white man.
