  1. As things stand, the woman can lawfully stay in the UK until her current visa expires but as the relationship has broken down, an application for either an extension or indefinite leave is unlikely to succeed.

    However, if, as you report, she is the victim of domestic violence, she can make an application for indefinite leave now. She will have to demonstrate the DV, though, which will include reporting it to the police and going to hospital to have any injuries documented.

    Correct there is every likelyhood she will be able to stay. I would add though that the immigration rule dealing with domestic violence is very liberally interpreted. Get the ball rolling now. Get her to a GP now. Introduce her to the local womens domestic violence organization. Get a good ( legal Aid ) Immigration solicitor or go to the Immigration Advisory Service. Its helpful if there is a police report but it is not essential. Anyone who has seen the injuries can be a witness in any application to the Home Office.

    Now I love a pint of cold cider on a hot day. Its dam expensive about £3.00 per can in most bars I stumble through . Shall revisit the Queen Vic whilst getting a new suite on Soi six next trip.

    Kurgen has a punctured lung, the knife came very close to his heart, don't think it was damaged. First night in BP was 70K baht.

    The other person is a local lawyer who told a very different story to the BIB. :o Kurgen will need some help here. :D

    Is his Embassy involved now. Surely this is a prime case where our diplomats should have some sway make it unequivically plain that our nationals can not be harmed with impunity. The days of sending a gunboat up the river may be long gone but we still let the ex pm hole up in Mayfair when he had some " difficulties ".

    I put almost all my money into this girl and her family and she and her mother took me to the cleaners. Yes I know that there are a lot of guys with similiar stories but my ex did in fact commit a crime and I am the good guy trying to recover my assetts.........

    I was drawn to the phrase you use she committed a crime. That I think betrays some very unclear thinking on your part. Civil litigation needs focus.

    Get a good lawyer now. One thing puzles me though. Did you put all your assets into the house ? Don't you have other capital or income?

  5. Dont't worry mate. My cover letter will explain that the circumstances and that the GF is in the UK. I have emailed the embassy to ask if " in person " means the actual person who is applying has to be there or just that they do not issue by post. If its the latter it should make no difference where the GF is as to whether she merits a visa or not.

    If they do not answer I suppose we will have to suck it and see. If they refuse to accept the application at the appointment on the basis that she is ouside the country thats one thing if they will refuse it on that basis. Well I am not sure they can can they?

    It would be a complete pain in the bum to fly back to BKK to do it in person.

  6. I have emailed the Embassy but no reply yet. I see that visas are issued by appointment. Does the proposed visa holder have to be present or can the application and appointment be made by a relative. My GF is in the UK and I am planning to post her passport back for her sister to take with the application.

  8. Cheers Kerryd I had a google myself anyway the girly made contact with my Girlfriend yesterday so she is ok.

    As an aside for anyone who has an interest in these things the UK will shortly be signing a number of conventions which provide for a mite more help than the UK previously gave victims of trafficking. A " competent authority "is now in the pilot stage to identify victims before coming fully on line before Christmas and our various police forces, SOCA etc are dusting off their passports to pursue enquiries in sunnier climes if necessary ( see ex policeman arrested in Thailand for people trafficking last week )

    A sensible post Carib and yes I worry about my girlfriends family if only because she does. I have no issues about Tattoo's nor those that have them. Its the nature of it.   13. My girlfriends little cousin, an idiot, flew to Europe Friday to be with a bloke she hardly knows ( don't get me started ). He has a very odd tattoo. Its an old ugly mans face about 10 inches long on his left chest. A very odd tattoo. Anyone know if it means anything?

    Shops ? There is an ok filipino in Wood Green Shopping City and a Chinese in Turnpike lane or try the Wing Yip Hypermarket in Tottenham

    Are you sure your friends know where they will be living? Tottenham can be a bit shit hole !

    There are a few Anglo Thai families but no real community focus so far as I know.

    Police are not entirely sure if the story is correct and suggest the girl may be simply looking for a free ride back to Bangkok, however a report of the incident was made and Police are looking into the case further at this time.

    Glad they are not pe judging the incident . F me free ride to Bangkok. Who makes up a story like that .

    Step 1

    Get a copy of the whole application put in . Scouser or anyone else will need to see exactly what information, statements, evidence was provided to the ECO.

    Step 2

    If as I suspect it was a f'd up application from the begining further representations as to the true state of affairs may result in a favourable review.

    Step 3

    If it was completely f'd up consider making a new application which satisfies the Immigration rule rather than appealling.

    Step 4

    Appeal and wait for a hearing date in about February 2009.

    The rule is Rule 297 go to the BIA website click on law and policy click on rules and there you have it :ose his is the rule

    (e) one parent is present and settled in the United Kingdom or being admitted on the same occasion for settlement and has had sole responsibility for the child's upbringing; or

    As far as sole responsibility is concerned Pliny you are 100% correct Emmanuel is the starting point.

    "The phrase sole responsibility is not to be interpreted literally, literal interpretation would defeat all claims Emmanuel 1972 IMM AR69. In Sioley 1972 IMM AR it was considered that the mother who left her son but had sole financial responsibility and being continuously consulted about the childs schooling and upbringing had sole responsibility. It was contended that the source and degree of financial support of a child and the mother’s genuine interest were relevant. In Martin 1972 IMM AR71 responsibility could be delegated to a relative. The more relevant to this particular appeal is that once sole responsibility has been established, there is no requirement to assess as to how sole long the parent with sole responsibility has held it. In Namaju 2001 INLR the tribunal having dismissed an appeal whereby they thought that mother who had had sole responsibility for 2½ months insufficient to satisfy paragraph 297(1)e. The Court of Appeal allowed the appeal stating the relevant issue under that paragraph as simply whether the parent had sole responsibility for the child and the length of time sole responsibility has been held might only be a relevant factor as to whether the parent actually had sole responsibility. Once it was established the length of time was not a relevant consideration. "

    I make the point of including a submission I would use at appeals ( above ) because if your Thai Immigration Consultant does not know that stuff then they HAVE NO BUSINESS advising on Immigration Law.

  20. I was thinking of going along to see the Torch run ,

    but i don't think i will chance it, it will only need one nutter to kick off and knowing the police they will just round up everyone .

    Personally speaking I am planning to boycott as many products sold by olympic sponsors as I possibly can. It always puzzles me that the Thais dont get more het up over seeing Buddhist monks beaten, abused and murdered. ( Burma also ) . Mbai pen rai. The tourch will be back in UK soon for some other publicity thing. I read the Ausis have the right attitude threatening to arrest any of the blue tracksuited thugs who attack demonstrators.
