The child is Thai because of the mother. The question is if your child was bootn in Australia and if you legitimized the child according to Australian law. If you did, a Thai judge might recognize you as the legal father without having to go to court here.

There is no process in Australia to legitimize your position in the same way the Thais do. Under Australian law you are considered the legal father simply by being listed on the Australian birth certificate.

Jay I believe there is an Aussie lawyer in Chiang Mai who specialises in family law in both Australia and Thailand. Just search Google for "Australian lawyer Chiang Mai".

To the last poster- Yes indeed. If child happens to have Thai mother and comes to Thailand for holiday it is my understanding she may keep the child. So this should be on everyones 'Watch list'.

I read a UK man ran off with son.... Thai mother sued for sole custody in thai court.... thai mother reported father for kidnapping.... child shipped back to Thai.... Father battling in Supreme courts and likes unlikely. Whilst she was clever- it would not take too long for this strategy to be mentioned to a thai family whom may do anything to have the No 1 best hope for the future back.... then again money talks over hear.

Been able to get a weekly visit yet if the X is there I get a earful of smack. I need to remember to RECORD the smack talk. I think the best place for this topic is Chiang Mai. As it is amazing to me that we have no genuine & professional Mediators in Cmai. They maybe able to resolve conflicts & headache many of us go through. Without the sort of action some pay for.

The rates to formally mediate via the better law firms seems excessive for thailand. In terms of lawyers as a whole, like anything there are good/average and bad.

I have heard thais can get lawyers for a fraction of what we pay...in many cases even for free. This means more risk in the case & negiotation will off the table. Fact is this will be a once in a lifetime shock to the village thai family who are asset rich yet cash poor. No other solution seems avaiable than causing all great hardship for months.

So what does my son do now until the case finished, as he is passed around the whole village. The sole purpose being to extract ceremony $$$ fr me. Comments like have ceremony & pay 200k then see ur son when u wish.

Some thais have the habit of thinking that a farang can take no action. This is far fr the truth and l pity the girls family for what they may lose. A mediator with evidence in hand could resolve the conflict peacefully. Yet only option appears to be hard & harse. I do not believe there are no good mediators in all Cmai.

I guess will seem laughable to many on this forum but I will ask anyway.

Has any of you long timers used a Mediation and Negotiation Service that proved successful? When you had a break with a partner. I hear the laughs now.....

Naturally all lawyers not really seem willing to do and those that will charge 5000-8000 baht every hour and seem defeated before they begin. So I see it in their best interests to drag it out as much as humanly possible and live off our pain and suffering- Lol. Bit too much but we all know lawyers.

The matter is to do with parental rights over my son. I was granted sole custody in Aussie, now need to prove in court I actually the Dad and then apply for custody. Aka. 200,000 baht later the bills will still be coming and it a long drawn out process.

Whereas i know the Thai family will accept a cash offer to give me parental power, only I need a good mediator on my side to get this done. As naturally my X has stated I am the most Jai Dam person in the world. So i cannot visit or access my son in anyway, unless used force. Or other tactics that are a risk to our health and wellbeing.

He only has Aussie Passport with myself listed as sole parent. Granted sole custody when she stabbed me and was given a suspended jail sentence. So court wise they feel no issue, yet I will need to wait months for my son. I would prefer a quick and speedy outcome... plus I need to have custody until court. Even if they dispute my rights. I need him in school and being looked after by my current partner.

Now as I can show passport and papers I can pick him up from the grand parents by thai law, but not the MUM in this country. She often heading from Lamphun to Chiang Mai to catch her next Farang, so that is when I plan to take him from the Grand Parents. They will put up one hell of a fight in this small village, so I gather armed security needed.

Thus the mediator can simply stress the situation and the expense of court. Then they will hand over my son with visiting rights for them all peacefully (yer right), etc and receive a nice cash payment for all their troubles. Done Deal.

In Aussie we need to attend x2 Mediations at least, before it enters court and 97% of matters never reach court due to this fact. So it makes perfect sense- NO..... saids the legal teams here and they seem to take a large step back and large breath at even the thought of us reaching an agreement. I try tell them I worked as a manager of a law firm in Aussie and it works very well if performed correctly and professionally. NO....

Please understand. There is *NO WAY* for you to become the legal father of the child in Thailand without going to court. Not unless you married your ex, which it doesn't sound like either of you would be willing to do. So stop fighting the court option. Find a lawyer you like in Thailand and start the process.

The Thai family courts are very reasonable compared to some courts in the West. They really do put the interests of the child first. If you can prove your ex is a danger to the child then you even stand a chance of getting sole custody. I'm not sure just a criminal record in Australia is going to be enough to meet that level of proof, but depending on the circumstances it might be.

Listen to your lawyer in this case. Court is absolutely the path for you. Short of marriage or waiting until the child is 7, there is no way to avoid it and be the legal father in Thailand. Once the case is submitted and the mother realizes that this will go before a judge, you may find her more reasonable about many things.

Yes agreed.... do not think a pay off to the family will work this time. Or the pay off would be far higher than court itself.

Yes let the court decide, many have told me to gain custodial power here is more reasonable than our own courts in many cases.

When asking a question it's really important to be clear. What you stated above is subject to multiple interpretations. Is there a birth certificate? Are you listed as the father? Is your ex-girlfriend Thai?

If you are listed on the birth certificate, and you are an Australian citizen, then take the birth certificate and whatever else is needed according to Australian law to the Australian Embassy and secure an Australian passport for your son.

If you are not listed on the birth certificate, and since you were not married to the mother, you have no standing and are virtually powerless.

Yes listed on the Aussie birth cert.... mother is Thai yet our son not registered. Also had DNA testing in Aussie and have these results to show I am the father. I am Aussie.

For what purpose do I get another Aussie passport for him. I have no access to him so how to get passport photos, unless clip and chip from photos i have as best I can.

I gather the passport would be for retreat to Aussie. Was not the intention as work and live here with another spouse now.

Also my son has my surname, as I insisted he got my name in Aussie. So contemplated a retreat for a couple of months via passport back to Aussie. Either new or old one... yet old one he came in on last year is securely locked away with Thai family.

It was hell trying to get the paperwork done to add my son to Thai House book and make him thai. So the paperwork still sitting in my house, I highly doubt my X is capable of doing herself.

Seems to be a legal mess and x2 lawyers do not seem to have the answers.

My X GF left with my son a few months ago... back to her village and drops him off with grandma. Back to catch a farang in Chiang Mai.

Now they not letting me visit or be Gunned down in this remote village. As my X makes up anything in the world to spite me.

I cannot get legitimized as father as he not Thai.... he Aussie. X Gf cannot be bothered making him Thai and lets him remain illegal in the countryside.

He only 2.5 years old. X has criminal record in Aussie and was refused VISA so legals say easy custody win. At least majority custody 5\2 and that all you need.

Also if I win Primary custody then I know the thai family will not be bothered to visit, as I will make it as hard as they made for me the last 3-4 months.

My X played this game a couple of times in hope I beg for her return for the sake of my son. We are way past that now... I simply wish to see my boy and no one able to help.

He is in limbo in Thailand.... as an Aussie. Told Aussie Child Services and Police- naturally nothing they can do in Thailand.

I feel very stuck... others suggest more serious action and have team to do, yet was hoping for peaceful solution. It considered kidnapping unless we were married. Depends on person..... if u tourist area the girls trying to catch Farang + need to make a few bucks. It is simply a small bonus if u handsome and young- last I hear we all are- Lol.

Spicy, etc are places of last resort...... cannot pick up their then nowhere.....except Mai Sai I guess Lol.

Thai girl i know TRIES to hook up at restuarant then quiet 4 star bar then lower levels then finally Spicy. So she gets min 500 per night...... max approx. 3000-4000.

Simply put- these girls do not get handouts- they NEED to work sometimes to support a growing family back in the village.

Exceptions are really knowing thai language and culture and you will not be caught dead in tourist area. Yet if you tourist or within 3-4 years here Yer good luck picking up at the thai only places.

Anyway I seen many men go for work ethic and personality over looks and good for them in the long run. Thus why most of us are goners or have been several times.

Then as about to be towed the guy wanted 2K for 2 hours work. I said 500 bt will do, as we talking some Ajarn wages here. NOPE- they got nasty and we at stale mate.

Being stubborn sort of guy.... involved Mae Rim Police (Big Mistake). From their it all doooownhill- Lol.

Police wanted 4K for tow to town and refused. Called friends and one helped out and found one for 1000 bt back to town then told police where to go (Yer right).

The tow driver was soooo afraid of police he waited around corner for 2 hours before he left. BY the way I could only get 2 hour fee down to 1000 baht with police.

Moral involve any police 'forget it', only friends who been here forever. Should have known better yet did not wish to complain to mates unless necessary.

So now I have back home in San Sai Noi all in bits and i guess ready for gears to be worked on.

Let us hope makes up for the pain and suffering through the day by quoting me 3K- Lol.

Case being built for FULL Custody- with choice for Dad to allow visitation or not.

Her criminal record for court in assault with deadly weapon- HUGE.

So an issue to get this done.... an offer been put forward to buy child as court cost them also. Girl not giving as much as receives so parents to decide.

End of day they take money and hand over OR court for sole, if not will be 5\2 our way.

Housekeepers, child minders, stable spouse must be in place before attempt full custody I think and takes time. Then move and select whether u wish Mum to ever see again as she working bar 95% time anyway.

No hard feelings here- she must do what she must with no education and she can pull nearly any man she wished for a good amount per night. So why not in her mind.

This cannot last for ever.... in 30s now, so the young 20s giving good ran now. Another few years maybe.... then suffering for my son.

But all will be concluded in few months. I hoping current spouse will accept- Lol. Or a deal breaker in our relationship- yet I think all OK.

Not at all, I regularly do it under 3 hours, its a very good road and very wide in most places, so plenty of room to avoid things if need be....would rather drive than put my life in the hands of a someone else and as for the bus!

3 hours is ok speed- never over the limit. Mostly average approx. 90km to conserve gas. Buses simply to slow on hills and corners plus your life in hands of bus driver and I seen some near corner crashes over the years. Making the whole day into well over an 8-9 hour ordeal.

Anyway looks like no takers for a seat.... Mai Pen Rai.

All of the real world data in the fiber lines being offered to consumers shows it only marginally better than better quality ADSL lines, and no better than dual lines with a load balancing router (if download supports that). The 20 Mbit package pulling in about the same as the 10Mbit line also.

Basically just because they are being advertised the true 'up to' 100Mbps lines are not performing anything close to it.. 10Mbit being about all anyones seeing.

I do understand bangkok has some condo based fiber connections, but these are not like the True 'ultra' packages being offered.

If theres better FTTH up here would be good to gather real world data. I will get a True Ulta installed shortly and relegate my current 6Mbit to a back / load sharing line.

LivingLOS- not what I asking yet appreciated. Sorry if my request did not seem to request shop or biz center.... as i have 10\1 at home and it can take days for down\uploading when it will take hours in a Fibre center ideally.

Business centers or shops in CMAI ANYWHERE with 100Mb down and 10Mb up are supposedly around.... Yes at 200-300bt ph yet would be worth it for occasional usage. Cmai is lacking in these centers and Web searching shows only monthly rentals for business.

Anyone tried the Airport Biz center internet.......any good or crap as normal.

The issue is *NOT* the last mile. Whether you have ok'ish ADSL or if you have high performance fiber, the real choke point is still the international gateways. The peering points where CAT/ TRUE peer with international backbone ISPs are quite limited. All the end consumer focused ISPs in Thailand (3BB, etc) all end up using CAT/ TRUE/ TOT as the upstream ISP. When these ISP are quoting download speeds, they are talking about domestic bandwidth, not international. So finding an establishment with a fiber connection, is only really going to be worth it, if you are doing domestic downloading.

Biz idea for anyone is SUPER Shop for International professionals- those of us working in CMai to get super fast internet speeds, fast color prints, storage, etc, etc the list could be endless. Whilst CMai a GREAT city for cost of living and access to our food, whatever we want within reason.... business needs not so easily met here. So many return to BKK to get their small biz operating correctly then outsource.

ANYWAY- Super fast internet shop in CMai appreciated or center or Uni or whatever to use occasionally as i am desperate to transfer approx 5Gb from 1 Host to another TODAY. Not likely yet I will try.
