Just wondering if anyone has any different news on a thai child born overseas, but living in Los now can get a thai passport.

As TIT, we have all been told 3 or 4 different things by 3 or 4 different people, heck I have been told 3 or 4 different things by the same person.

I want to know if there is any other way to get a thai passport here in los for a child born overseas, we have been told we can ONLY get it through the embassy in home country, this involves actually going there, or mailing the passport and documents there. I am not that keen to send the originals by mail from this country.

Anyone know any different ??

This is an extract of a document available from Thai Embassy in Australia.

I imagine that it will be no different for a Thai national living anywhere in the world, to get a thai passport/citizenship for their child.

REQUIREMENTS FOR NEW PASSPORT OF THAI CHILDREN BORN IN AUSTRALIA

Children born in Australia can apply for a Thai passport provided one or both parents

are Thai national(s) with an existing Thai passport.

1. Thai Birth Certificate

2. Parents’ valid passports together with 1 copy of pages 1-5 of passports

3. One copy of marriage certificate of parents

4. Both parents must be present to sign the consent form; otherwise, must comply with

requirement 5 below.

5. Consent form and Power-of-Attorney from parent who is not a Thai national,

authorizing Thai parent to apply and obtain a Thai passport for his/her child and; in

cases wherein only one parent is present at the time of application.

Look it is possible to get a Thai passport in Thailand for a child born overseas. I was born in OZ but applied for my last one here in Thailand. But, my first one was issued in OZ, as for Overseas born Thai's, it really is the path of least resitance.

Thing is, you need to understand that the child first has to be identified as a Thai citizen, whereby after which all things are possible. The first step for all Thais is via the Thai birth certificate which identifes you as such. If you are born in Thailand you are issued a birth certificate by the Ampur you were born in, and if you qualify, it will state you are Thai.

Now, the problem is, each Ampur only has juristiction for issuing birth certificates to those who were born in the boundries. So, being born overseas, that responsibility is transferred to the Thai embassy in that country, which issues a different style of birth certificate. A Thai Ampur will have no ability to issue this, so you at least need to contact the embassy in the country you were born to issue this.

Now, if in Thailand, once you have the BC, you can go to the Ampur where you live, get put on the house registry (a legal requirement if resident in LOS). The slight problem here for you is that (in my case at least) for people who have OS issued birth certificates, they need to see the entry stamp in the passport showing when you entered Thailand. In my case, as I had entered into LOS on my Thai passport (and not my Aussie) it wasn't a problem. BUT....given your child entered on a non-Thai passport, I am not sure how well that will go down (cause there is one box not ticked on the checklist..).

With the BC and the house registry in hand, you go the the PP office and apply.

The only issue with this approach is that your child entered Thailand on a foreign passport, and the next time they leave, will have to leave on that passport, technically at least.

I'm not sure if it may create problem is the child tries to leave Thailand on the Thai passport, as the computer system (from reports on the site) is pretty good at making sure people check in and out of the same passport. With the Thai passport in hand, you may want to go down to immigration to see if they can somehow transfer over the entry stamp into the new Thai passport, so that your child is 'here' in Thailand as a Thai. (confusing, I know...)

So, what would I do? Given that you have to get the BC from overseas anyway, why not just wait till you are back for a visit, and get the paperwork, and then simply re-enter Thailand on the new passport. The child can overstay penalty free on the foreign passport until they are 14 anyway.

We tried this, we have the birth certificate from Oz, but we have been told on several different occassions, amphur, Immigration office and lawyer that did my visa, that we have to 'APPLY' for thai passport through embassy in Oz ONLY as he was born in Oz.

You know, as with most things, it has me buggered and bewildered why, but thats da rules as they say.

I even have an email from thai embassy in Canberra stating the same, said we can do it on next rip back to Oz, but can also send via mail, but as I mentioned I have no confidence to send so many original documents via the mail from here.

As for waiting till we go back to Oz, can do, but I would just like to get it done sooner than later 'if' possible from here.

He obvioulsy has been here for the last 4 years on overstay and I have travelled with him and it has been absolutely no problem, but would just like to get it for him now.

Funny thing is my daughter who was born here, does not have a thai passport either, but has an Aussie one and citizenship and she has not even been to Oz yet lol.

Totally understand about getting the paperwork sorted. It can be a pain. Our little one has three nationalities, which was a pain to establish.

You are in what in Thailand is a chicken and egg situation.

To get the Passport in Thailand, you need the BC and the house registration, and for an Adult, the ID card. But, you can't get the house registration without the Thai Passport for an OS born Thai child!

Embassies however, usually can waive the rule for the house registration and ID card requirement, as Thai's born OS or who have live there for a long period of time may not have a valid house registration or ID number. So that is why in this case, they are the ones to issue the PP for your son, as they follow a different set of rules.

This only applies for their first passport however, as then once they are in the country on a Thai passport (and get registered) then subsequent PP's can be applied for in country with no hassel.

If it means anything, I've couriered stuff to the RTE in Canberra before no-worries whatsoever. You then get them to post the stuff back to you by courier, or to an Australian address who you trust and they can safely courier it all back to thailand for you. Next time you leave Thailand, he checks out on the Aussie PP (cause he entered on it) and he comes back in on the Canberra issued Thai PP.
