Do British children need a Thai visa? Also, I want to make my son a Thai citizen as his real father is Thai. We are divorced and I have a new Thai husband who would like to adopt my son. How does one go about all this? My son's real father is not helping as he is a very bitter person. Any help would be appreciated.

if your husband is registered on the thai birth certificate i think u can get him a thai passport and then he does not need a visa for thailand (goes in and leaves on thai passport not british one thats the law); same for england enters england on brit. passport, leaves on brit. passport.

there's a guy named 'samran' that knows this stuff really well here on thai visa try asking him?

if i remember correctly, u had a lot of comlex situations w/son and ex and new husband , cant remember, but adoption has been discussed among the men in the general forum several times, u might want to search TV for adoption etc.

Does you son have a UK or Thai birth certificate.

If Thai it should be very easy to establish Thai nationality.

For a child, the natural father has to sign when applying for a Thai passport.

Otherwise it gets much more difficult, but not sure how difficult.

Fortunately I am on good terms with my stepson's father and he came with us and signed

so there were no problems.

everything Astral says is correct. The two parents named on the BC are supposed to sign for the passport on behalf of the child.

You'd best ask the passport office what to do in situations such as yours. I'm sure it isn't uncommon that one of the parents is unable to sign.

Thanks folks. My son has a British Birth Certif. His natural Thai father is on it. But the natural father lives in UK and won't help. I want to make sure my son is a Thai citizen in the first instance, passports can come later. Can I do this alone or can his stepfather do it? Cheers

WRT Thai citizenship I would advise your new husband (Thai) to ask the Thai Embassy, if you are in London maybe he could pop in to talk to them as a personal approach Thai to Thai is always best to ask about your sons citizenship.

If you travel to Thailand with your son who only has a British passport then he will need a Visa but recent postings here seem say that any overstay is waived for a child.

As for adoption, I have no advise but I would think a number of members would have adopted their step child but if none come forward, as presumably you will adopt in the UK, if you haven't already done so you could check these sites

As you can see from the attachment your son is considered Thai, this is regardless of his having a British birth certificate. actually the only circumstances when a child born to a couple, one of which is Thai, is not considered to be Thai is where the non Thai is an illegal alien and by its very nature that can only occur if the child was born in LOS.

Having said that your situation is not without its problems. Unclear if your new husband are planning to adopt in here or Thailand ? But in either circumstance some degree of co-operation from the birth father is required, or at least a lack of obstruction. You really need to see a lawyer as you need a paper to show you have custody of the child in Thailand to get the passport . Without co-operation from your ex husband its not going to be straightforward to claim Thai Citizenship for the child, a lot depends on the documentation you have, a Thai marriage certificate would be a step along the way. But you will need a lawyer. Good Luck.

PS. I don't suppose that by any chance the father registered the birth at the Thai Embassy ?

Thanks everyone. I will talk to the Embassy while I am in London. That was interesting info in the jpg in the post before this one!!!!! Where was it from please?
