Status Of Foreigner Babies Born In Thailand

I realise that this post si somewhat old now , but the advice given was very good and i was hoping someone may have some knowledge which could help me also.

I am the father of twins born here 2 1/2 years ago my wife is english and so am i . We both have 3 year non imm B visas and work permits with 4 years uniterupted non imm b and work permits prior to this. We were both married here in Thailand. My children have UK passports in oredr to allow them to leave the country and re enter. On their thai birth certificate it states illegal alien ( i presume because we do not have PR)

My question is this ..... can we apply for thai citizenship for the twins retrospectively if we get PR ourselves.

We have no intention of returning to the UK we have established our life an business here in Thailand and i am looking at merley safeguarding my childrens future. If we must obtain PR for them to appeal or apply then i may as well begin the process now .

If you get a RP you can apply for Thai citizenship, provided you live in Thailand for more than 5 years, pay a lot of tax and you can speak Thai well. It is however very difficult. For information on PR and citizenship look at the pinned treads.

As they are only 2 1/2 at the moment their english and thai is only at a basic level , sawadee , kop kun Krab, Nok , Mai etc , althugh they do wai already and we send them to a small thai school nursery to help them with this . We are ensuring that they can and will be able to speak Thai. Do you know if there is an age limit on them applying , i am sure at the speed they are learning Thai they will very quickly out do Mum and Dad !!!!

Your'e welcome. For now just focus on getting residency. That will be difficult enough and takes a lot of time. You never know if the rules for getting Thai nationality will change in the mean time.

Not for the thai citizenship very much, but I am more concerned about the VISA for my child (due in 3 months time). Will he have to get a visa to re-enter once he leaves Thailand?? How can he/she benefit by being born in Thailand?? Do I have to register the birth somewhere in the immigration department??

Someone even told me that "any child born" in Thailand, can decide at age of 18 weather he/she wants a thai citizenship or not?? Is it true??

Make sure you register the child's brth with your own Embassy to make sure he/she gets your nationality and eventually a passport!!

And make sure they give you a signed official document, too. Very handy when applying for a passport (years later in my case, and back in Europe).
