And yes they could just have a salling but it will not have stop the bad driver

Which is no more legal than having 2 adult and 2 kids on a bike, as these were deemed illegal many years ago!

 

The people on the bike did not cause the accident here, people need to get over that, it was the carelessness of the car driver pure and simple.
