Hi there,

I think this was probably covered somewhere already but i can't find it. I am about to extend my Non Immigrant Type O (based on marriage)for the second time . It will expire on 23rd February . How much in advance do i need to apply for the extension . Another thing is i am about to receive my new Passport , which passport should i bring to the immigration ,the old one which has been discarded (i think they use punchers to make it "un-valid") and the new passport, or should i get the extension in the old passport (without the punched holes and still valid)and later transfer the extension to the new Passport?

You should do with between 3 and 4 weeks remaining - now. But you may have a reason to delay.

You can only do with a valid passport.

The extension will be limited to the validity of the passport if less than one year.

Once you obtain the new passport the full extension can be entered into it.

If your new passport is about to be received then take it and the old passport - the new extension of stay will be entered into the new passport. If you expect passport before expiration of extension of stay I would wait for it.

You will need the old and the new one. They will verify the NON-O visa (and date) and transfer it to the new passport. Then the extension will be placed in the new passport. I've seen that a letter from the embassy/consulate is needed (in my case US consulate automatically supplied me with the letter), but others have indicated they didn't need to show it (letter).

Will ask my Embassy if they can make such Paper(letter), not sure though what was written on it....
