Non-Imm O for dependent spouse of Non-Imm B holder with work permit

A bit of a tricky one here, so help appreciated.

 

Spouse applying for non-imm O dependent based on husband working with non-Imm B + work permit (within first 90 days of visa which has not been extended for 12 months yet).

 

Spouse applying at VFS Delhi, all documents are in order, except!

 

However, on the document checklist, it states

The VFS staff is saying that as the original non-imm B of husband has already been active for 30 days and there are only 60 days left on the original visa, so it is not "valid" for 90 days from the date of application.

However, it was originally valid for 90 days obviously.  It sounds like an impossible condition to fulfill as after entering the country for even 1 day, then the non imm B will only have 89 days left on it?

As such, it would be impossible for  a spouse to apply for a non-imm O until the 12 month extension of stay has started.  This seems like an unfair separation of family.

 

Does this sound right, and has anyone else run into this?

That apparently is what they want. 

Extension of stay is mentioned in the screenshot you posted.

The requirements for visa applications in India are a stricter than in other countries. At many other locations they will issue the non-o visa at the same time the non-b visa is issued.

Thank you very much.  I am just wondering if she came on a tourist visa, could she extend or convert the visa to non imm O based on husbands (by that time) 1 year extension of stay?  Otherwise, she would have to come in on tourist visa and fly back to do this non imm O after 60 days.

It is would be possible for her to enter on a tourist visa and then do a change of visa status to get a 90 day non immigrant visa (category O) at a immigration office when you have your extension of stay issued.

She would need at least 15 days remaining on her 60 day entry to apply for it.

Thanks for the great info.  Is it possible for her to do this conversion, even if she has an Indian passport?

Also, what is the earliest date that the conversion could be made?  Is there any link to the list of docs required?

Any nationality can apply for the change of visa status.

There is no earliest date as long as you have your extension and before there is 15 days remaining on her entry.

One final question Ubonjoe, can the husband 12 month extension of 90  day non-imm B, and the wife conversion of tourist visa to non-imm O dependent be done back to back the same day?  Can this all be done at the One stop center in central Bangkok or is a trip out to Chaeng Wattana required?

Also any link to both the latest TM86 conversion and extension of stay forms is much appreciated.

The application for the change of visa status to obtain a non immigrant visa could be done on the same day you get your extension.

It could be done on the one stop center if your employer has BOI (Board of Investment) privileges. If not it has to be done at Chaeng Wattana immigration.
