Child's overstay with Non-O visa

Featured Replies

My 5 year-old son entered Thailand with Non-O Dependant visa. Is it true that children who overstay as dependants are treated more seriously (severely) by Immigration than children who entered Thailand with Tourist visas and overstayed? I'm talking about long overstays, e.g 1 year.

Your replies will be greatly appreciated.

Children under the age of 15 are not fined for an overstay but do get a overstay stamp. Under the age of 18 the overstay banning rules do not apply. But that does not mean they are exempt from needing visas or extensions of stay.

Their basis for staying here makes no difference.

Complications can arise from overstaying though. For example some schools may not let them enroll and attend school.

Also if on an overstay they would have to leave the country to clear the overstay if you decided you wanted to change their stay to a legal one.

Thank you, ubonjoe. You are very knowledgeable.

If, e.g. the child has a 1 year overstay, can there be complications for him to receive a new Thai Non-O visa outside of Thailand?

There should not be problem with the overstay to get a visa for a child. A child is not responsible for something they had no control over.

so if a child below 15 will (with a Tourist visa and ASEAN passport) overstay over 30 days, once he get out of Thailand will he be allowed to re-enter with a tourist visa or they will refuse entry even if not considered persona non grata ?

If the parent is allowed to enter, the child will automatically be admitted also. Maybe this will change at some point in the future, but neither the child nor the parent are currently held accountable for breaches of immigration law by the child.
