SE non-o Thai Child is copy of birth certificate enough? Or alternative border runs (visa exempts) to buy some time

Hi,

My situation is a bit of a mess (at least in my head) since i was thinking of going back home but kind of changed my mind due to several things (children involved), i have only a few days to resolve my situation

I'm on a non-o (marriage) but its expired and so did the marriage ? i have a Thai children, and was thinking i could get a single entry non-o in Vientiane. i got copies of

Child birth certificate Thailand (copy don't have the original) have my name in Thai/English, but not legalized.

Copy from child BC from abroad, its not signed by mother.

Copy of wife's house book - font/last page signed

copy of child house book entry (not 100% sure, but it looks different than the wife first/last page, since this is a A4 paper) (not signed)

original and signed copy of marriage certificate

Now, what i'm worried about is that i don't have the original Thai birth certificate, and also if i need something else. I could get the original certificate, but at the time of arrival, i would be on overstay which i dont think is an good option, even if 2 days.

getting a 30 day extension to current non-o (marriage) is not an option as i'm currently 500km away from them and ex is working etc.. just don't fit into my situation

So question is, should i just proceed to Vientiane and hope everything is ok with just copies and would it give me any issues than i'm changing from wife to child non-o

Or go to a nearby land border (near bkk/patty) and get a visa exempt (is that even possible anymore and what would i get a 15 days + possibility of extension)

or go Singapore and stay 2 days and hope i would not get any issues with a 30 days visa exempt in Swampy (As for visa exempts. my last one was 8 or so years ago, I've been on B(work-permit) and non-o since then

My preferred options would just drive to a land border and do out and get back on a visa exempt, even if only 15 days, it would give me some time to get prepared properly. So yea, trying to buy some time, to get my stuff sorted.

Any input in all of this mess are very appreciated since i'm so confused as to what i should do and time is running out

There is no longer a 15 day visa exempt entry rule for land border crossings, it was rescinded in January of last year. You will get a 30 day entry.

Just avoid doing the border hop at the Poipet crossing.

Are you divorced or just separated?

If your marriage extension has expired, what Visa/extension are you currently on to remain in Thailand.

Any other options nearby pattaya/bkk (reachable by car) and you don't think it would give me problem that i have many non-o and then suddenly need an exempt?

just separated, waiting for the authorities abroad to fix the formalities. currently on a expired non-o on last entry, trying to get the right visa next time, but lack of planning (many decisions because of kids) made all of this a mess

No problem at Ban Laem or Ban Pakard for the crossing to Cambodia. Or the Ban Phu Nam Ron crossing to Myanmar in Kanchanaburi.

You could still get a multiple entry non-o visa based upon marriage since you are not divorced yet. The visa would remain valid after the divorce is finalized.

But that should be in Savanakhet  right (i have the funds, but not in Thailand, so cant show thai bank account statement with the required funds)

Exactly what I was thinking and why I asked the question.

No proof of funds required at Savannakhet.

ok, so options are to either get a marriage non-o ME in Savannakhet (similar to the one i have now) or SE based on child and try get a 1 year extensions in Vientiane.

Or land border run at  Ban Laem or Ban Pakard or ban phu nam to buy some time and plan my laos trip better

Anyone think it would be an issue at all to go from non-o to visa exempt and then back to non-o?

You would apply for a one year extension at a immigration office not in Vientiane.

Not a problem.

Other than the Non Imm O ME Visa from Savannakhet, any other Visa or a 1 year extension would require proof of funds.

If it buys you more time to plan a trip to Savannakhet, no problem, as long as the divorce doesn't come through in between time.

In your original post you do not mention if you have the marriage certificate in your possession, you will need this to apply for a ME non o visa.

I guess you missed this in the OP.

yes, i got the original marriage certificate (translated, stamped and everything), but it just seems so much easier for me to drive to cambodia and do a visa exempt and then plan a proper trip to laos and arrive in lao and have to wait over the weekend for the visa etc etc

Also i'm sure that divorce wont be finalized in the near future since that takes some time in my country.

So current plan with help of you guys is something like this

1: Drive tomorrow or Friday to ban laem/pakard land border to cambodia which seems to be the nearest to Pattaya, (about 4 hour drive)

2: get a visa exempt 30 days (with a possibility of get another 30 days extension at the emigration)

3: plan/travel to Savnakhet in near future and get a real non-o based on marriage (alternatively plan a non-o based on children SE with 1year extensions at emigration)

Did i miss something here?

As long as you use a friendly crossing for the visa exempt entry you shouldn’t have a problem. Carry a copy of your marriage certificate or child’s birth certificate when entering just in case you are questioned  about your reason for entry.

You will need a copy of your wife’s I.D. if applying for the Non ‘O’. You don’t seem to have that in your list.

I would try and get all the documents for a Non ‘O’ (spouse) and head straight to Savannahket for a ME Non ‘O’. Then you’re sorted for up to 17 months.

went to ban laem today, got a 30 days without any issues. trip was 9 hour return from Pattaya (Friday traffic)

Thanks for all your help, i will pursue a real visa in near future, at least i got a couple of weeks to do that trip ?
