Overstay, options now.

Hello everyone.

 

I entered Thailand the 24th november. I was planning on extending my visa by 30 days for 1990 baht but really screwed up and didnt manage to go to the office on friday before it closed. Now im a little unsure about what to do.

 

I would love to get some advice because i dont really like this situation to be honest. Usually this is not something i would ever do.

 

Questions i have:

1) I assume not but i ask anyways. Can i still go to the immigration office and extend my stay? I read a few places that if office was closed when your visa run out you can go there on first opening day and its still ok?
2) Will there be a problem doing for example a visa run now since i overstayed? Maybe harder get back in after short time away from thailand, meaning just 1 day in other country and go back.

3) If i decide to do a visa run is there a difference between doing it by flight or crossing border with a bus/car etc when you have overstayed?
4) If i have 20 000 baht, i shouldnt really be worried about anything other than loosing 20k baht if police unluckily stop me?  My flight home is the 1st of january. What if i get caught tomorrow , pay the 20k, do i have to leave the country immediatly?

Probably.

 

If your permission to stay ended on Friday you’ll have to pay 3 days overstay (1,500 baht) before they will issue the extension. If it ended on Saturday/Sunday you shouldn’t be charged the overstay.

Shouldn’t be a problem by land at most crossings with a few days overstay.

If you were caught on overstay you could be arrested, detained, sent to court, fined by the court (less than 20K), detained at the IDC until your flight, escorted to the airport, banned from the country.

I am currently in Nakhon Pathom.

 

Is this a good place to do the visa extension? Or is it better to go to bangkok and do it?

Im just really scared if im denied visa extension, what happens then? My flight is on 1st of january.

 

I read somewhere if you are denied then you get 7 days to leave the country? Anyone can confirm this?

If so i should be good.

I came here the 24th of november.

 

So if my calcuations are correct. Today sunday the 23rd my visa runned out (visa on arrival 30 days).

 

I dont really care about if i have to pay i just dont want to risk end up in jail at christmas time lol.

 

I have money, im just scared they deny my extension. I know the chances are pretty small for it to happen but you never know if you bump into the wrong person at the office.

Getting an extension should be possible

Nakhon Pathom is not far from the Ban Phu Nam Ron crossing, so if i were in your situation i would drive over there and make a visa run instead (If you didn't get 2 visa exempts at land borders already this year)

Why is this better? Just because cheaper? Money doesnt really matter to me. I just want it fixed. Is it safer to do visa run? I havent crossed any land borders this year, only arrive by plane in bkk

For the reason that you mentioned before, i wouldn't feel well to surrender myself at an immigration office when you can't know what will happen there 100%. At a border the situation is clear, you pay the fine and just go ????

Of course most likely nothing special will happen at the immigration office, and you will just get your extension after paying for it and the fine for overstay

Of course most likely nothing special will happen at the immigration office, and you will just get your extension after paying for it and the fine for overstay

And if i do visa run i can go back the same day? I never did one before.

The problem of returning at the same day exists only at crossings with Cambodia, the crossings to other countries (in this case Myanmar) don't have this problem

If you google "thaivisa Ban Phu Nam Ron" it looks like no problems this year, except one guy who had his bike stolen while he was making his border crossings, so if you drive a motorbike there maybe take a lock with you ????

You’re right about the 23rd, but the date will be stamped in your passport.

 

You should have no problem applying for the extension on Monday. No need for a border run.

 

They have no reason to deny your extension. If they did they should give you 7 days to leave the country.

You Don't get banned from the country if it is under90 Days overstay i think.. 1 week won't be a ban

If you turn yourself in at the airport on your way out, or pay the fine at an immigration office - no ban for under 90-days overstay.  But if you get "caught", then the whole deportation, banning, etc, occurs. 

 

In general, if more than a few days overstay, best to go straight to the airport - not to an immigration office.  But if just 3 or 4 days, no problem - pay the fine at the office, and pay for an extension (at least 7 days given, even if the extension is denied).

The 90 day rule only applies if you surrender yourself at the airport on the way out, or maybe at an immigration office (not advised for long overstays).

 

If you are caught on the streets - even with a 1 day overstay - you can be banned. IMO getting caught with a short (unknown how short - IMO 7 days) overstay is unlikely to get prosecuted, but you stand a big chance of being extorted if caught by the wrong BIB/IO. However, if you were caught with a 80 day overstay you would almost certainly get prosecuted through the court and banned.
