Leaving a school with no contract and no work permit

Featured Replies

Hello all!

I am hoping you might have some information for me.  I am leaving the school that I work for because they refuse to give me a contract and hired me to teach a class that they do not have which means that they are making me sub all over the school.  My question is...if I don't have a contract and I am within my first two months of being employed(so I have a 90day non-b but not a work permit yet) can the school cancel my 90 day non-b visa or try to take legal action against me?  I am aware that they can cancel my work permit which would void my visa but since I don't have a work permit I am not sure what they can or cannot do.

Thank you!

You should know that working without a work permit is illegal, so you worked illegally at this school.

They can't cancel the permit to stay which you got from your visa. (Only an extension of stay could be canceled)

If you are on the 90 day entry from a non-b visa it cannot be canceled. You can stay in the country until the 90 days ends.

Assuming the school is not holding your passport, just give them a resignation letter and go. To try to take action against you with immigration, they would need to testify that they were employing a foreigner illegally without a work permit. Even then, it is unclear that you would be in any serious trouble. They have no hold over you except that they can bad mouth you to other potential employers.

why did you start the job ?

illegal is illegal and you are illegal.

Very helpful.

This may let you on overstay in the future, be careful as some immigration officer may ask for proper cancellation of your non b visa when you are trying to do an extension in the future

Non b visa was issued for a particular purpose (EMPLOYMENT CONTRACT WAS ONE OF THE DOCUMENT) you should have a contract

A 90 days entry from a non b could be cancel if issued by your local immigration

This is not correct info, if his entry was on a Non-b visa, then he was given 90 days entry at the border entry point he entered Thailand and him leaving the school will have no effect on this whatsoever.

Not every job offer turns in to reality and not every non-b visa is issued for actually working.

If the OP doesn't intend on finding another job in Thailand, then there is no option to extend this 90 day entry, other than to visit his Thai wife or child, which is unknown if he is married etc.

The chances of the school trying to take any legal recourse are almost nil, they have acted illegally by employing the OP without a work permit and this would only highlight it, which I'm sure they would not want to do.
