Trying to help a friend out regarding a visa for her husband - they were married recently and he's a US citizen.

 

If he wishes to work in Thailand does he apply for a Non O based on marriage or a Non B? What are the requirements for the appropriate visa?

 

I'm unsure about his current visa as its a little confusing so better not to go into that but as I understand it:

 

If he's on a Non O or Non B at the moment, he can apply for an extension within Thailand and will be required to report every 90 days?

 

If he's on any other type of visa, he must first apply for a Non O or B outside Thailand then apply to extend that once he's in Thailand?

If married to a Thai he can get a work permit and work with a non-o visa or extension of stay based upon marriage. He could use the income from working to meet the 40k baht income to apply for a one year extension. The advantage of doing that way is that the extension is not tied to his job.

To have a work permit issued he would need a non-o or non-b visa entry. And then he could apply for a one year extension.

If on a tourist visa or visa a exempt entry it possible to change to a non immigrant visa at immigration (category O or B).

Thanks for that Joe.  Its long, boring and I don't really understand the situation myself so I won't try to explain it here but..... let's say he went for a Non O and then applied for an extension based on marriage with an income of 40,000 baht minimum.

 

Could that income come from abroad and if so, would tax and social have to be paid in Thailand?  That might seem cockeyed as, if he is staying in Thailand - how can he working abroad?  However, you may remember the story of another friend who had a problem at Korat Immigration - he runs a business (with WP) in Thailand with his Thai wife but Korat Immigration insisted that his 40,000 MUST come from abroad. That situation has now been rectified but its lead me to ask the question about where the income comes from.

Income from outside the country is what most people use to for the 40k baht income option. No tax receipts and such are needed for that income. Either proof of income from a embassy (if possible) or proof of 40k baht going into a Thai bank from abroad for 12 months (less this year or for the first extension) will be accepted.

Thanks once again Joe, sorry to be a pain - I've tried searching for this information but I find the search facility a bit frustrating (as with most other Forums).  I read somewhere on Thaivisa that there is some form of leniency with regards to proving income on the first application - clearly if someone has only just moved to Thailand, they can't show 12 months of transfers, what are the rules on this?

 

Can I also make a suggestion (unless you already have this and its just me that can't find it). On another Forum that I used to be a member of, we had things called 'Sticky's' - that was a thread containing information on a particular subject that was often discussed/questioned.

 

For example, I posted a guide to preparing a folder of evidence for a UK Spouse Visa application. That thread became a 'Sticky' and always appeared at the top of its relevant section. Thereby people looking for that information could find it easily and save the same questions being asked over and over again.

Thanks once again Joe.  There seems to be the usual 'Thainess' in that order - 2.18 refers to Family members which includes those married to a Thai national but in 'Procedures' talks about 'Pension' and retirement.  Can I just take it that for the first application, the income needs to be in the applicant's Thai bank account, shown as a foreign transfer, 1 monthe beforehand? And that all future applications must show the income in the same way for the entire 12 months previous?

 

Finally, at the end of the column headed, 'Document' - have you any idea what this means?

 

'The alien spouse or father, mother of the Thai national must prepare an affidavit of status.'

What's this?

As per the example only one month of income is needed to do the first extension application. After the first extension 12 months

will beeded.

Just ignore the pension and retirement wording. Those were the best words to fit what was written in the original in Thai used by the translator.

The affidavit is a statement completed at immigration when the application is done. It is a fill in blanks form in Thai.
