My uncle is visiting the UK from Thailand. He is a UK citizen. He has has lived in Thailand for 14 years on a Non Immigrant visa O. He is retired. He has a Thai wife and has bought property in Thailand. He has a visa on the basis of Thai wife. Every year he renews the visa and then has to renew every 90 days. There is a continuous period of such visas for the last 4 years. There have been no lapses.

He came here in May but his visa had lapsed. His visa lapsed prior to him returning to the UK for a holiday. He paid the visa expiration fee on leaving Thailand. 

He is now due to return to Thailand and is trying to apply for a visa. There seems to be some confusion as to what his options are.

Can he apply based on his previous stays in Thailand or does he have to apply afresh - single entry and take it from there. We have created an account online as per the instructions on the Thai visa website.

Any advice would be gratefully received.

Every 90 days he reports his address, not renews his visa.

He applies afresh.

 

He should apply for a single entry non-immigrant O visa as the spouse of a Thai. When he returns to Thailand he will receive permission to stay for 90 days. Within the last 30 of the 90 he can apply for a 1 year stay as before.

He paid the overstay fee. He might be banned from entering.

Depending on the length of overstay he can apply for a Non Imm O Visa in UK and extend in Thailand for 12 months.

This is an important question. If it was less than 90 days he should have no problem applying for a new visa. If it was over 90 days (but less than a year) he would be banned from returning for a year. A longer overstay (depending on exactly how long) would mean an even longer ban.

 

Hopefully his overstay was less than 90 days.

I mean it's not clear written in the OP. But I guess the Uncle had extensions the last 4 years and done all his 90 days reports.

So the overstay would be only a few days (my guess from the story). So mean the Extension now is finished and have to make a new Non O Visa back home.

 

But should have confirmation from "Angela36"!
