Hi,

 

I am a 53 year old British national and I have a Non O Guardian Visa based on supporting my Thai daughter.

 

I applied for my Non O Guardian Visa at the Thai Consulate in London in November last year. It therefore expired in November this year, however I left the country before it expired and came back in again which has given me permission to stay until January 29th 2020.

 

I would like to apply for a 12 month extension of stay before January 29th however I need to visit Australia early January for a couple of weeks, arriving back around 22nd of January. I can't apply before then as my daughter is currently out of the country on holiday visiting her Thai mother and doesn't arrive back in Thailand until a day before I leave for Australia.

 

My questions are as follows:

 

1) Could I apply for the 12 month extension say on January 24th 2020 (5 days before my permission to stay expires) or do I need to have a bigger gap between when I apply and when my permission to stay elapses?

2) If I do apply on January 24th and there are some issues with my application such as additional paperwork that is required due to constant rule changes etc which would require me to go to the district office in Korat etc, would they give me additional time beyond January 29th to do this?

3) Once my application is made can I travel overseas during the 30 day period when my 12 month extension is 'being considered'?

4) Are there any other issues that I should consider?

1. Yes

You will apparently will be applying for an extension of stay based upon being the parent of a Thai.

2. You could apply for a 60 day extension to visit your daughter and then apply for the one year extension near the end of it.

3. You can apply for a single re-entry permit that will be valid to the report back date shown on the under consideration stamp if you need to travel.

Many thanks for your excellent advice as always.

 

1) Regarding your point (2), just for clarification on the 60 day extension, you said "You could apply for a 60 day extension to visit your daughter and then apply for the one year extension near the end of it" - When you say "visit my daughter" - I live in Thailand permanently and my daughter lives with me permanently (apart from an annual overseas trip to visit her mum for 2 to 3 weeks), does what you say still apply, i.e. that I can apply for a 60 day extension and then apply for the one year extension shortly before the 60 days expire?

 

2) For the 60 day extension, do I need all the paperwork that I would normally need for the 12 month extension?

 

3) Do I need to show the 400K in my account for 3 months leading up to the application or is 400K 'on the day of application' acceptable?

 

4) I did the 12 month extension based on my Non O Guardian Visa for around 8 years on the trot but then got a job and a work permit for 2 years. Every successive year that I applied for the Non O Guardian Visa 12 month extension, the list of documents required became longer and longer and required multiple trips to immigration with the additional paperwork requirement. However they did not publish this list on their website or anywhere else that I know of. Does a current list of documents required by Chaengwattana Immigration for Non O Guardian Visa exist anywhere by anyone? I'd like to save myself an additional trip/trips to Chaengwattana if possible. For reference, below was the last list that I compiled from my last 12 month extension in 2016. Thanks.

 

1 Form TM7 + photo - Extension Of Stay
2 Form TM8 + photo - Re-entry permit (single only whilst under 30 days consideration)
3 Form (No Code) - Transfer Stamp/Visa to a new passport
4 Copies of all pages of passport including TM6 (Arrivals/Departure) card
5 Copies of Daughter's passport
6 Tabien Baan
7 Copy of Daughter's Birth Certificate
8 Copy of her mum's ID Card
9 Copy of Daughter's ID card
10 Photo of me and daughter, 2 inside condo and 2 outside front door of condo showing room number
11 Photo of me and daughter, and daughter alone outside of school
12 Court order + final 30 day decree
13 Kor Ror 11 (need to get original copy from Huay Kwang district office)
14 Letter from school
15 Letter from Bank showing 400K + bank balance
16 Copy of bank book on day of application to confirm balance is still above 400K
17 Condo rental agreement and owner ID card

1. Visit is used in the police order. It does not matter if they are living with you.

2. No

    She needs to be with you apply for the 60 day extension. Her birth certificate and a copy. Copies of her house book registry and ID card.

3. The rules do not state it has to be in the bank for any amount of time. But some offices may want it to be there for 2 months whe you apply.

Your list appears to be complete but I suggest you contact the office where you will be applying to to find out what they require.

In point 2, would her Thai Passport be acceptable instead of her Thai ID card as she doesn't have one yet (went to apply for her first Thai ID card yesterday but that's another nightmare story as to what they've asked me for document wise).

I took the following documents with me to the application office. Note that her Thai mother has been living abroad for 8 years. We have never been married. I have raised my daughter alone for the last 12 years.

 

Thai birth certificate

Tabien baan

Court order from the Thai family court declaring me as the legal father

My daughter's Thai passport

My British passport

 

When I went to get her first Thai ID card at their BMA Express office in Gateway Ekamai they said the following (list not exhaustive as I switched off 50 minutes into the conversation as I started losing the will to live):

 

1) They wouldn't accept her birth certificate as it was an official copy and not an official original. I originally went to two Thai district office to get these documents (as the originals got destroyed during a flood), the Prakhanong District Office said that we should go to the Huai Kwang district Office but still ended up with only an "official copy" rather than "official original". No idea why they can't just issue and original. No idea where to get an original copy.

2) They wouldn't accept the copy of the Tabien Baan that she was registered on with her mother as it's a different address on her birth certificate.

3) They needed a letter from her school to say how long she had been there.

4) They wouldn't accept that I'm her father and needed a Thai national to attend to confirm that I was.

5) They complained that my daughter couldn't speak Thai. She goes to a British school in Bangkok and can speak some Thai, but it wasn't good enough for them apparently.

 

My Non-O guardian visa expires on Wednesday this week and I want to extend it by 60 days tomorrow (to give me time to prepare all the additional documents for a 12 month extension) but I fear that I am going to have the same issue with the birth certificate and Tabien Baan.

 

I would be very grateful for any advise that you could give me.

It is only needed to apply for the one year extension of stay based upon being the parent of a Thai.

The legitimization of your parenthood can also be done at an Amphoe to obtain Kor Ror 11 if she is 7 years old or older but it would require her mother's presence or a notarized consent from her.

They cannot issue a new birth certificate. What they would normally do is certify a copy and attach a printout of the birth registry. It is the same for a marriage certificate.

Number 2 and onward is mostly nonsense.

I would guess that many Thais do not have a tambien ban registry that matches their birth certificate.
