Workers in thai company - are they ALL expected to stay put during working hours?

So, I've currently got 2 workers in my company which will soon be a year old - they have been registered from December and everything like SSO and taxes is paid.

 

As I lost my income from Europe and also need to get onto a 1 year extension as things are now I am contemplating changing field of expertise and actually taking on 2 more.

 

The two workers I have will be valuable to me if I keep going, BUT they work from home - the registered address where they have had their pictures taken is with my lawyer, guess that takes care of any inspections and so on.

 

If I scale up to 4 I will need to change the address, and then I would have the problem of not having reliable office hours - my field is IT and visual/creative, its more or less become the norm to work from anywhere.

 

Also I would have to scoot around a LOT myself, I do not want to hire someone to just SIT there waiting for an inspection!

 

I would guess the inspections are not scheduled in beforehand, if so I should have no trouble getting at least 3 to be present.

 

Would the field of expertise of the company have a bearing on this? Or perhaps the job title, if I hire a sales agent they can hardly expect that employee to stay put during all the office hours!


If I expand it will carry a lot of risk businesswise, so I cannot afford any severe mixups around inspections and having to deal with the ministry of labor for weeks or months...

I would think that as long as the 4 employees are paying tax, that it wouldn't matter if they where absent at the time of an inspection, but surely your lawyer would be the best person to ask.

Apparently its not that simple... I got the going rate of 2000 baht per missing employee from the lawyer, clearly that was something that is expected to be paid if they are not present! No receipt, of course.

 

The regulations seems to be made for hotels, restaurants, factories and even bars only - I guess some people would go "why don't you just set up a BOI", but that is another scale of investing... Maybe later!

If there is an inspection, it is perfectly acceptable for you to call your employees into the office. That is what I have done, since sales people are often in the field. I would never pay an inspector for an absent employee. If the inspector does not wish to wait for the employee to arrive, then that is their problem.

When applying for extension on a work permit declare that that need to be able to work all over Thailand. 

Shouldn't be an issue anymore but better to have it on paper.
