if I apply a visa now, I will be arrested with overstay?

You would not be on a overstay if you applied for a visa and immigration gave you a under consideration stamp.

OP how did you enter Thailand. Meaning visa exempt, tourist visa or ?

Are you not able to obtain embassy letter to obtain 30 day extension. What is your country? 

My school/agent said I'll be fine and not on overstay even though I won't get my passport back until October. Immigration knows I've applied for an ED visa. I went there and gave a slip direct to an officer and had my picture taken.

You should have your passport at all times.

True in theory but impossible in practice if you use an agent. They will keep the passport and give you a copy until the process is completed. Meanwhile the passport will go "on tour" to whatever immigration office they are using.
