OA to Marriage

my friend (not speak English) is under OA visa , he married a Thai woman this year.


He wants to transform his visa into a Marriage VISA.


His plan was to go to LAOS to do it.


But now if he come back from LAOS He will be he and his wife under 14 days quarentine.

by any chance do you know if due the COVID the immigration rules will allow him to do this Visa Marriage without leaving Thailand ?

If he is currently on an O-A Permission of Stay (entered Thailand with an O-A Visa and was given 12 months Permission of Stay) he can apply for an extension based on marriage to a Thai in the last month of his permission to stay.

So do not need to go to Laos ?
Can be done in immigration office Pattaya ?

No, and cannot as land border closed anyhow.....

Note it will be an Extension based on marriage. Can apply in Jomtien if he lives in the area.

He will only change the reason for the 1 year extension from retirement to marriage. Like an earlier poster said, when there's 30 days left of his current 1 year extension he can apply for the extension. But he must also meet the financial requirements. Either 400k in a bank account 2 months prior to the application or 40k/month regular income.

he went to make his extension in July in Jontiem and they tell him he had to it from outside thailande ??

My root visa is an OA, at the end of my 1st year permission of stay I just walked in the IO, applied for and got my "Thai Wife" extension. No questions asked. This was 6 years ago.

They do not do Extensions outside Thailand.

He probably talked to the wrong person and they were wrong. There no rule or regulation that states it cannot be done.

As said many people have done it.

When his current permission to stay based on his original Non Imm  O-A Visa (or the retirement extension of it) almost expires, he should apply at his local IO for the 1-year extension based on that original Non Imm O-A Visa.  And he has to specify on the TM-7 document that goes with that 1-year extension application that his appliction is for reason of MARRIAGE (to a Thai national).

Of course he also needs to meet the requirements for that marriage extension application.

When using the money-in-bank method to prove his financials that means he has to show evidence of at least +400K on a personal Thai bank-account (a joint one is not accepted by IO).

Note: It is worth to mention that he should not apply too early (it can be done from 30 days before permission to stay expiry), but do it in the last week because the new 1-year extension of stay period will start from date of application because of this switch from retirement to marriage.

Also, it is useful enquiring beforehand at the local IO for a list of the requirements for an 1-year extension for reason of marriage.  I attached a fairly recent list of the Marriage extension requirements as required at SiRacha (sister-office of Jomtien), but as these requirement are prone to frequent changes, it is best to check whether there have been any amendments made in mean time.
