I am a Brit gay guy in thailand who also has resident status in Spain. My BF is Thai, we are together over 1 year and are happy.

Due to severe family problems I now have to go back to spain for a long time, maybe months or years.

I need to know:

can a Thai enter Spain (or the UK) for an extended period? will a guarantee be needed? what about as half of a gay couple? How do Thais normally enter the Uk and spain if it is not a student visa etc?

Spain and the UK have civil ceremonies for gay couples, and in spain this is maybe even 'better" than the UK.

Can i bring my BF to either and then "marry" him to ensure that we stay together?

does anyone know a website which has answers?

any info at all appreciated, even if incomplete/relating to non-gays/pertaining to either country

It is possible for your partner to apply for a civil partnership visit visa for the UK. This will allow you to get "married" and you would then be able to apply for a visa for Spain under the provisions of the relevant European law which means that as you are a Brit. living in Spain, his visa should be free.

Do you know how kindly they are about giving that visa? Is there a website which tells us about it?

It sounds like it would be better to be married in UK rather than spain.

I was under impression that they did not give out thses visas much cos of abuse. Is the UK now enlightened about foreign gay partners?

Your partner can apply for a particular type of visit visa which will allow you to form your civil partnership in the UK. He would have to demonstrate that there is sufficient funds from his either his own or another party's resources to pay for the trip and that he intends to leave the UK at the end of the visit. He will also need to show that you are in a relationship and that you have arrangements in hand for your civil partnership ceremony.

Civil partnership is now recognised in the UK, so the embassy can't refuse the visa on discriminatory grounds, and providing that your partner meets the requirements of the immigration rules, there's no reason why he shouldn't get the visa. Indeed, I have a client with similar circumstances to yours for whom I'm in the process of preparing such an application.

Points:

Because of my circumstances and property holdings, it may be more expedite to "marry" in Spain. I realise u are not a spanish lawyer. I am UK citizen but hold Spanish Residency Papers. Also, the socilaist gvment is Spain is allowing many partnerships. Do you know anything about the Spanish end? I am not a Spanish citizen.

I am able to enter Gibraltar for my own part

because of the unanticipated problems I now face in Spain (Parent crippled etc), we do not have much evidence of a 2 year relationship (we are 1 year and 2 months approx, but from our early months we only have birthdays cards etc) Is this a problem?

A civil partnership undertaken in the UK will be valid in Spain, too. Once your have the registration paper, you may then use this for the purposes of obtaining a free visa for Spain as your partner will then be classed as your dependant for the purposes of European law. The 2 years' worth of evidence you refer to is only for the purposes of an unmarried partnership, so does not apply in this instance, although you will have to demonstrate that you are indeed in a relationship.

The situation is very complex. I have now flown from BKK to Spain, leaving my BF with enough money to pay our bills for 2 months, although my mother is very ill (the reason for flying) and it is expected to be a long haul, months or years.

The situation is compounded by the fact that I am in Spain, as my mom has resided here for many years. I too have Spanish residencia, still required by Spain (despite EU) for living, working etc in Spain as a non-tourist.

Some further questions:

As a Brit resident here, can you advise whether the civil process can be undertaken in Spain following application to Spanish embassy in BKK? Or, could you advise me of any website for Spanish immig law?

I could probably fly to the UK for a short time in order to "marry". If we are unable to marry in Spain, as above, would my BF need to go to the UK embassy in BKK to get the papers started<'? I do have other family in UK with the same surname as I and owning property (I don´t have UK property). If he can apply to the UK embassy in BKK, what sorts of hoops will he have to go through? What must he show or prove (especially as I am not there)?

What kind of time frame must we allow?

I believe that my BF may be able to get a Schengen visa and be sponsored by a friend in Belgium. Once he landed there, he could fly to Spain (they do check passports at Spanish airports for passengers from EU, but not at borders). This may not be a good option, but how long will it give us? could he then jump ship and stay in Spain while we appeal for him to stay?

How much would you charge to take this case and process his UK (or Spanish??) civil P visa?
