Hi everyone,

i have been reading some of the other topics, and maybe someone can help me?

first time user so be gentle

first some background info, 6 years ago i met my wife in oz thru a friend at work who is also married to a thai , she was on a visitor visa for three months, during that time we fell in love and as advised by my friend if we wanted to continue our relationship it would be easier to deal with immigration if we were married.

my wife and i have now been happily married for 6 years, my initial embassy horror story went like this, after her returning to thailand (visa conditions) the application was lodged and her interview was approx 4 months from this date. The interviewer had not even had the decency to look at the aplication before the interview, this was evident as an interpreter was required but not present, this annoyed her greatly and i think she had already made up her mind then to refuse the visa as she waited for an interpereter to arrive.

some of her reasons for refusal that appeared in the official letter were " i had not been back to thailand to visit my wifes parents" (both listed as dead in the application for almost 30 years), "no meaningful communication between us since she returned" (had bills for over $5000 dollars worth of international calls with telstra (ouch!!) to her home number in thailand, approx 50 letters to and from in a mixture of thai and english, a letter from the principal of the language school were i was learning thai for 6 months) and my wife had not returned and i had not visited her since we were married (she had been refused 2 holiday visas to return to oz, and i had a letter from my employer stating that i could not take holidays during that 4 month period due to it being the run up to xmas and it is our busiest time)

thankfully with the review tribunal sanity returned and it took them all of 4 days from recieving the review in canberra to assign a case manager, send it back to the decision maker in adelaide and to overturn their decision and direct them complete the application, (probably a new world record, the official letter from the mrt basically said that the decision maker in thailand was totally incompetant), of course this then took the aussie embassy in thailand another 5 months to actually get round to doing it

Now to current issues my wifes daughter from her former relationship in thailand was originally blocked from coming to oz as the father wanted her to complete primary school before he would let her go , he however has taken little if any responsibility in her upbringing and she has stayed these last 5 years with my wifes sister, seeing him occasionally, with me supporting her from oz monthly, he has now relented after 5 years and has signed the letter of consent, the application has been done and so far the service from the embassy has been excellent ( i cant believe i just wrote that), they actually phoned me on my mobile to tell me they had recieved the aplication ( only 3 days after it left oz) and to say that they had emailed me with a few more things that they require, all the things that they require are straight forward except for 1 item

which brings me to where i could use some feeback, because my wife was never officially married they require what is called a por kor 14, which is done at the local amphur which states my wifes marriage status to her former partner, when the relationship ended , how many children were created and the childs current living arrangments, and what contact is maintained between my wife and him, etc

the case manager at the embassy is insistant that we require this form which really amounts to a stat dec/ affidavit in oz and no other form is accepted

i think it pretty unreasonable to have to travel to thailand for 1 hour to do a form and return not to mention that the money could be put to a better use preparing for her daughter to live here

does any one have a contact higher up the chain i could discuss this with at the embassy or even heard of ways to get around this little problem for me.....

My wife has these documents, she also has them from her mother and sister...her mother lives outside of Thailand but was there on holiday....Interesting was that she brought her son here on a holiday without the actual consent of the father and neither did she have a court order giving her sole rights to take a child overseas...??

Unfortunately unless the Thai consul in your home city can help then I would think it is time for your wife to have a short holiday.

That should be acceptable....it would be the same as getting one from an Amphur.

i shall try that first, i still have 35 days to lodge further details with them, so if i have no other choice i will have to send her over there, but i still think its rather stupid and unnecessary considering my wife has been living here for over 5 years and her relationship with him ended over 9 years ago,

i think the person handling the application is just reading of a list of requirements not actually looking at the details, and looking at the info on the aussie embassy website it says a por kor 14 should (not must) be supplied, however with my previous dealings with them you can see why i am worried,

Hi, is it possible for you to download this so form fill it out etc and send it yo your sister-in-law to have it stamped in Thailand and for her to post it onto the Aussie embassy? Just a thought.

my wife had too get the same from her family and relo's saying that the father of my stepdaughter had nothing to do with the chid at all since birth,we were lucky she had her sister and niece in pattaya at the time.

we went to bunglamung,and did the statements from them and translated them into english and thai,and took them with us to the visa section at the towers

,thats was just for a tourist visa,but u need it [by rights for any visa]if u are taking a child out of the country..i missed which embassy u are applying but you will need that which ever way u go,

in thailand at the towers not the embassy.with all the forms and paper work

good idea but its supposed to be done in person at the local amphur where the interviewer asks the questions, however i had some good news today as my wifes sister was allowed to fill this form out today in thailand at the local amphur ( she has been looking after her for the last 5 years that my wife has been in oz), this is after the initial enquiry she had done there told her no it had to be my wife, it just goes to show that in thailand if you dont get the answer you want the first time keep trying because on a different day there is obviously a different set of rules. have already checked at the embassy and they said this would be fine as long as they get a por kor 14 they will be happy. :o:D:D

great news today,

after trying to get someone at the embassy to contact me for about 5 days to tell me the status of the application i finally got through to the case manager( she had been absent for 10 days), after quoting the file number she informs me that the visa has been granted, which is of course fantastic news.

the only worrying thing about it was that from her tone on the phone it sounded like it had been granted for a while and she was suprised that i was calling, as yet no one either in thailand or here in oz has been contacted to tell of the decision and no official letter sighted or email sent. the last contact i had with her was 3 weeks ago which she told me that they had everything they wanted and there should be no problems and that she had handed the file over to the supervisor for further processing

the case manager told me to contact my wifes sister in thailand to arrange an appointment with her for tomorrow to collect the visa which has been done,

just goes to show never let up on them even though they say it slows progress, it seems if you just let things run there course you likely are going to be waiting for quite a while as paperwork gets chased around the office

i would like to mention my case manager as she has been excellent through the whole process her name is Pattamaporn Aumpeng , she has been on the ball from day 1 and i would have to say rather helpful and at times even shown concern and humour, almost made me feel like i was talking to a person not one of their robots
