Kim Davis violated same-sex couples' rights by refusing marriage licenses, judge says

County Clerk Kim Davis, married 4 times with 2 kids out of wedlock wouldn't issue a gay couple a marriage license because she "believes in the sanctity of holy matrimony."  

She said distributing marriage licenses to such couples went against her beliefs as a member of the Apostolic Church, arguing that she could not give them a marriage license "under God's authority."

 

The decision leaves open the question of whether the former clerk is responsible for the legal fees of the two couples who sued and other monetary damages that have accrued over the nearly seven years of legal back-and-forth. 

A jury will decide whether Davis is liable for those fees and other damages, which likely stands around hundreds of thousands of dollars.

Nope, it's the county that's responsible for the damages .........

They employed her, they should have sacked her for refusing to do her job (gross misconduct) and employed someone who would marry the couples straight away.

Stood by her “moral convictions”…..except for the part about being married 4 times with 2 kids out of wedlock.

Yep and the whilst there aren't more like her in the rest world as they were too busy for the last 30 years inventing and pushing the "woke" world,  the Russians were busy developing their weapons systems that the West is now desperately afraid of as that is the real reason they dare not give air support to the Ukranians.  Seems a few people have priorities where it really matters and as to why a persons principles, in her case refusing to marry gay couples, is more important than peoples rights and lives elsewhere indicates that clearly the world has gone completely potty in my opinion.

The issue being, of course, that the money will come from thousands of taxpayers who did nothing wrong.  She should be held personally liable if she broke local, county, state or federal laws.  Not the taxpayers.

 

I understand qualified immunity if she made a judgment call in the absence of governing law.  But not if she violated the law.

Certain states are notorious for their DMV employees.  Just think of one depriving someone of a driver's license because "when I look in the rear-view mirror I don't want to see your ugly face."

For me the memorable thing about this incident was all of the GOP presidential hopefuls who went down there and were literally fighting (verbally) with each other to crowd her spotlight.  I recall Huckabee and Cruz, there may have been others.

Well, Justice Clarence Thomas is all sad because criminals will find it difficult to function in society.

“Due to Obergefell, those with sincerely held religious beliefs concerning marriage will find it increasingly difficult to participate in society without running afoul of Obergefelland its effect on other antidiscrimination laws,” Thomas wrote in 2020, five years after the decision, which did not produce the effect he claimed.
