Krungthep Thanakom claims BTS contract for Green Line extension services is illegal

Krungthep Thanakom, a state enterprise under the Bangkok Metropolitan Administration (BMA), has informed the Administrative Court that the company, under its previous administration, was not authorised to hire the Bangkok Mass Transit System Company (BTS) to operate the first and second extensions of the Green Line train service.

 

The board of Krungthep Thanakom, at its meeting last week, authorised the company’s lawyer to inform the Administrative Court, in writing, that the contract between BTS and Krungthep Thanakom was illegal.

 

Krungthep Thanakom and the BMA are being sued by BTS, demanding the settlement of 10.6 billion baht in accumulated debt for operating the two Green Line extensions.

It beggars belief that situations such as this can occur in enterprises financed by taxpayer money. And yet no one is surprised because these parastatals are run in a totally incompetent manner and that is the norm. Thailand likes to style itself as an emerging economy and not a third world one but it employs civil servants who could not run a market stall to handle billions of baht. No wonder the country is mired in corruption. There are no checks on rampant mismanagement and the ordinary tax payer is being conned.

Read the full linked article and last 2 paragraphs make it even a whole lot worse.

 

You sign contract. You don't pay your obligations. The other party sues you and wins. You appeal, and claim the contract is illegal as you had no right to sign it anyway, therefore is void and you owe nothing.

You are just trying to wriggle your way out of paying what you owe with a stupid reason.

10.6 billion baht will buy a lot of layer time.

 

Last September, the Administrative Court ruled in favour of BTS, ordering Krungthep Thanakom to pay BTS the outstanding debt, but Krungthep Thanakom appealed the ruling to the Supreme Administrative Court.

 

Any more info on the appeal?

I think BTS should just stop the train service without notice on these extended lines as they operate on void contract anyway and wait for the people revolt.
