jimmym40 Posted May 31, 2023 Posted May 31, 2023 As stated above, anyone know what the legal process would be. No will involved. Just would like to know what the property ownership goes to whom. Thanks.
lopburi3 Posted May 31, 2023 Posted May 31, 2023 Daughter and any surviving spouse if no parent per below. https://www.samuiforsale.com/knowledge/inheritance-laws-thailand.html
Peterw42 Posted May 31, 2023 Posted May 31, 2023 Unless otherwise stated in a will etc, an equal share to each/any child. Nothing for the brothers. https://www.samuiforsale.com/knowledge/inheritance-laws-thailand.html#:~:text=Thai inheritance laws designate intestate, equal share (section 1630).
MartinL Posted May 31, 2023 Posted May 31, 2023 Far from being an expert on this but, from past reading, it seems that where there's no will, the spouse (including a foreign spouse) inherits either:- 50% of the estate, children of the deceased than split the remaining 50%. OR the estate is equally shared between spouse and children. I've seen both scenarios mentioned. This is quite good and seems to lean towards the second option:- https://www.thaiembassy.com/property/thai-probate-and-inheritance-law If no children, parents and then siblings divide the estate..
brianthainess Posted May 31, 2023 Posted May 31, 2023 I'm a bit confused here, is the daughter hers and the brothers hers?
FritsSikkink Posted May 31, 2023 Posted May 31, 2023 Brothers have no rights, Spouse and kid(s) only.
