Any body out there who can advise me on this issue, I am 46 and British, I married my Thai girlfriend in Feb of this year all official, I have been living in Thailand for a year now but work month about offshore in Malaysia I have always travelled on a tourist visa owing to the fact I do not spend more than 28 days in Thailand, I am aware of the 90 day rule on tourist visas but have never had a problem, but I have noticed on my last three stamps the date has been highlighted, consequently I am rather concerned if I will be refused entry this time,My plan at the moment is for my wife to fly to Kualu Lumper and meet me there she will have with her, my bank book which shows over 1m baht,wedding photos,letter from my employer,copy of the wedding cert, then to go down to Penang and try for an 'o' visa there plus spend a few days holidaying, would I be correct in assuming I could attain that visa ? if not has anybody any more ideas.

You should be able to obtain a multi entry non immigrant O visa with that documentation and that is what you should have with your schedule. The rule is about visa exempt entry (which is what you were doing - not a tourist visa) and reads not more than 90 days in a six month period so you would be very close and probably have to stay out of Thailand a few days to allow the six months to start again if you continued to use these. Much better to obtain a multi entry non immigrant O visa.

That visa will allow 90 day stays for a period of one year from date of issue so no more close check of passport on each entry and plenty of extra time if you can stay longer than 28 day days on occasion.
