The Thai political landscape is witnessing yet another ripple as a fresh move by former Democrat MP Charnchai Issarasenarak seeks to have ex-Prime Minister Thaksin Shinawatra returned to jail.

 

Thaksin, a prominent figure in Thailand's political scenario and father of current Prime Minister Paetongtarn Shinawatra, has come under scrutiny once more for allegedly circumventing his jail term.

 

Having been granted a royal pardon last year upon his return from a self-imposed 17-year exile, Thaksin's initial eight-year sentence for power abuse was reduced to a single year.

 

However, it is claimed that Thaksin has not served this year-long sentence in full, avoiding physical incarceration altogether. Instead, he spent six months in a private ward at the Police Hospital before his release on parole earlier in the year, sparking accusations of legal manipulation.


Charnchai is appealing to Thailand's Supreme Court to rule retroactively, asserting that Thaksin had utilised his influence to evade jail, a move that is "categorically against the law."

 

The crux of the matter lies in whether the Corrections Department legally transferred Thaksin to the hospital. Normally, such a transfer would necessitate prior approval from the Criminal Court, something that allegedly did not occur in this case, regardless of Thaksin's reported "critical illness."

 

Should the Supreme Court rule in favour of Charnchai's petition, Thaksin could face returning to prison to complete his sentence. Further, Corrections Department Director-General Sahakarn Petchnarin could also face misconduct charges if found complicit.

If they jail him from using his influence to escape jail, then they should jail the man who let him escape... with a minimal sentence... which pretty much would put a lot more people in prison than just Thaksin... which includes many members of the outgoing government (from the PM on down)...

It's rather amusing when they say they want him to return to jail considering the fact that he never spent any time in jail. There is probably a 0% chance that he will be locked up. He's too rich to be locked up, guys with that wealth never see prison time in Thailand.

He's not too rich to be jailed, but he has supporters in extremely high places who control what happens with or without legal shenanigans.

Taksin has stolen billions of dollars from this country, he fled in his private jet,, lived his life up in Dubai and travelled the world whilst the people he swore to help have rotted, yes he should be locked up today they should add on that he escaped from prison and tack on another 20nyears then lock him up before he takes off again

I await the day when politicians petition the EC & the CC for the generals who led the last coup and then 'managed' the country for a decade to be charged with lèse majesté and overthrow of legitimate government. And then thrown in to prison for the rest of their days on this earth.

In think jail time should only counted as time when the person is actually in jail.

If the person, in this case Thaksin, is in a hospital, that is no jail time. Just stop counting when he goes to hospital and start counting again when he is back in jail.

This system would make sure that nobody is in hospital to avoid actual time in jail.

Just to get the facts straight, from what I have read about this since his return, he has never received a Royal pardon. His sentence was commuted from 8 years to 1 year, which is not the same thing, although the "journalists" employed by AN and Thaiger, as well as many on this forum, do not seem to understand the difference.

Is he really that different to many other Thai politicians? His biggest crime was to say that he was going to help the less well-off? (That's what some politicians in most counties do?).
