Hi all

Just tried to submit SV application for my wifes son in Thailand to come to the UK. They checked the docs & said he needed docs from Amphur in Thailand stating mothers proof of custody.

Sent all documents from UK some weeks ago with PK14 from Thai Embassy UK, they said its evidence enough. Along with evidence of funds etc etc

Son went with his uncle who has letter of consent to Sanom in Surin & they say the mother is the only person who can do the document!

Wondering if the person in Regents house has got this wrong?

The guy in Amphur is wrong?

Any suggestions?

Nowhere in the Immigration Rules does it say that proof of sole custody is required. What it states is that the parent who is wishing to bring the child to the U.K. must demonstrate that they have sole responsibility. Whereas a sole custody document is prima facie evidence of sole responsibility, there are other means of showing that the criterion is attained.

Secondly, it is not for the visa application centre staff to decline to accept an application. It doesn't matter one jot what documents they think are needed, after all, they're not trained in assessing visa applications. Your wife's uncle can insist that they take the papers as they are and, if you have otherwise demonstrated that your wife has (had) sole responsibility for her son and the other requirements of the Immigration Rules are met, the visa should be issued.

My mrs went to the local police station with her mother as witness. They got he cops to write out a stement saying that they had custody and the father is no where around and doesn't pay money toward them. They then had to take this to the local Ampur office to get the kids surname changed and a bit of offical paperwork verifying the police statement. ie : custody. I wonder if you wifes family can do it without your wife?

Thats all we need to bring them to Australia. I don't know about UK.

From the info i am getting he was taken aside & a ladie proceeded to go through the docs. She then said they were incomplete & the British Embassy needed the custody letter issued from a Thai Amphur? All docs & evidence were included already along with Translations.

I am now wondering was she simply advising & they have got mixed up. Perhaps she has not seen docs for SV's sent from outside Thailand?
