Hello ,  I currently live in a village with a family, the chanot is in the name of one person and now the family wants to divide into 5, each person will have a chanot: I agree to pay for 3 (9000 baht) but in exchange I want my name to be put on the chanot of my wife's daughter (although the house is in my wife's name, is this a problem?) I think this has already happened, I know farangs who were able to have their name put on the chanot : how to do it ?

Assume this is a house.  
 

More information may be needed.

 

Who actually paid for the home?  If a farang , was the sole person on the chanote their spouse or GF?

 

Did the other 5 contribute?  If not, they have no right.

it's a house, I paid for the house 

the sole person on the chanot is my sister in law ( sister of my wife ) 

my wife"s mother has the land, she gave him to his 5 children to build their houses and for convenience , put my sister in law name on the chanot

now they want to have their own chanot  ( my mother in law is very old and not in good health )

Did others pay help pay for the house.  
 

You already answered the question.  You paid for the house.

 

Why would you have the sister in law on the chanote instead of your wife?

All I can say is this is what can happen when a farang decides to build his GF or wife a house on land already owned by a Thai.

 

It gets complicated.

 

Best to avoid all together.

 

Does one really need this BS in their life.

 

You’ll never see the money you invested in the house again.

 

Hopefully, you won’t get kicked out of the house.

I believe foreigners name can be on the Chanut of a condo, if it is purchased in the foreign quota.

It can't be on the Chanut of a piece of land.

Wife's mother has big land and 5 children.

Puts single chanote in sister-in-laws's name for convenience.

5 children build houses.

Now they want to separate into 5 individual plots each with chanote.

 

They must decide on how to split the property and have it surveyed.

Then they have to apply to have single chanote split into 5.

Your wife's house/land chanote put in your daughter's name.

You get a usufruct, with your name entered on rear of chanote.

It's locked up in the safe but I recall it being on the same page as the rest. Its quite a large document and there are several previous entries and our names are in line as the next (last) entry.

On the front of the chanut will be the name of the person who registered the creation of the Chanut.

 

On the backside second to last line -third column will be the name of the previous owner (seller) and in the fourth column the name of your daughter (buyer)

On the backside last line - third column the name of your daughter (lessor) and in the fourth column your name (lessee).

 

Edit to correct as I now see that there were previous owners

my house is among 5 other houses , sisters and brothers, family house, not Thais from outside 

my name  will be on the chanote of my daughter in law ( not my wife, for personnal reasons )

as my sister in law said, each person will have 2 chanot, one for the land, one for the house ; my name will be on the house chanot  ; is it true, two chanots ?

I have seen the present chanot, it's true it's a very big paper, I  hope the new ones will be A4 format  because it's very difficult to print

There are no Chanotes for a house, only for land, and that will be in Thai name only.

My house is in my name, the Chanote of the land in Thai name. The house only can be in foreigner name if the building license was issued in the foreigner's name, and the land owner has to give permission for that. There is no mention of me owning the house on the Chanote, other than that I'm mentioned on the backside as the mortgagee to the owner. I have of course a building license issued by the local government in my name.

Once build it can not be changed anymore, because the house is part of the land..

 

I also see that a clown has awarded a laughing emoji to my first post in this thread, so I assume it is a loser who think he knows everything better

I just want it to be stated that I am a tenant of the house it's true that for that it has to be put on a chanot, which, yes, is for the land, but  that's what is said

You should consider getting a usufruct (สัญญาให้สิทธิเก็บกิน) which gives you permission to stay in the house, either for a specified duration, or for life. An alternative is a right of habitation, but usufruct has more extensive rights including ability to let out the house and receive the rent. Both can be done at the land office, and you will be listed on the chanote. Lots of info online if you google these terms or here in the forums. Recommend hiring a Thai lawyer to assist.

Having a Usufruct is probably the strongest protection for a non Thai. While you do not/can not own the land you can do things like renting out the land and that can last beyond your death. With an usufruct almost the only thing you cannot do is to sell the land.

However it depends on the local head of the land department if you will be allowed to get an usufruct on the piece of land.

A Chanote title, also known as a Nor.Sor.4.Jor (NS4J) is a land title it is not possible to have a land title for a house so that is not correct.

I spoke again with my sister in law, and there will two chanotes, because of an access road that will be on the side, to allow every one to access to their land 

the land will be perpendicular to the houses, not in continuity with the houses 

 

the 5 houses are next to each other and the land is in front of the 5 houses 

they have decided to do like this to avoid problems ( if any ) in the future
