workplace privacy being invaded - my gf's car was bugged

Featured Replies

she does not know whether to go to the police, or what to do? Is it legal for a workplace to record your conversations/track you movements? She found the bug in her car.  important to note Please  do not go down the rabbit hole of a jealous ex. she has been divorced 12 years . has 2 kids, he just upped and abandoned her, remarried and does not visit nor support the kids. my basic question is - what is the law, all joking aside. first thing I recommended is that she do is to wear surgical gloves and place the device in a ziplock bag (this may be a bit of an overboard reaction by me, but it is in case it  needs to be fingerprinted for evidence).

Legal Framework in Thailand:

  • Personal Data Protection Act (PDPA): Thailand's PDPA safeguards individuals' personal data and privacy rights. Unauthorized tracking without consent likely violates these protections.

  • Workplace Surveillance: Employers may monitor employees for legitimate business reasons, but this typically requires prior notification and consent. Covert surveillance without an employee's knowledge or consent is generally deemed inappropriate and may be unlawful.

Recommended Actions:

  1. Preserve the Device: Handle the tracking device minimally to maintain potential evidence. Using gloves and storing it in a sealed bag, as you suggested, is prudent.

  2. Report to Authorities: Contact local law enforcement to report the discovery. They can investigate the device's origin and determine if any laws have been breached.

  3. Consult Legal Counsel: Seek advice from a legal professional experienced in Thai privacy and employment law to understand your rights and potential legal remedies.

  4. Notify Your Employer: If you suspect the device was placed by your employer, address the issue with your company's human resources or management team to understand their policies and express your concerns.

Unauthorised tracking infringes upon personal privacy and may contravene Thai law. Taking prompt and appropriate action is essential to protect your rights and ensure your safety.

Was it her personal car, or a company car assigned to her? If her personal car, how would they get inside to plant a bug? If company car, then probably not illegal.
