I have been with my Thai girlfriend for 3 years. We have a 1 and 1/2 year old son. We are not married and live in Phuket. We own 2 properties here and I own 3 in the Uk. We are considering moving to England due to financial reasons. We do not have much money in the bank. My son has a British passport. Will my partner be able to get a residence visa for the Uk? - I would work in the Uk and she would look after our son. I would appreciate your experiences and advice folks!

You will be better off in my view, in the Visa forum, however, I will in-put what I can.

I have been with my Thai girlfriend for 3 years.

Have you proof of evidence? Joint accounts, letters addressed to both of you at the same address etc.

We own 2 properties here and I own 3 in the Uk.

This will help to provide proof of income and a suitable place to stay for your family.

We do not have much money in the bank.

There is no specific or stated amount of money required, only that you can support yourself and your family without the need for Gov't support.

Will my partner be able to get a residence visa for the Uk?

You will have to go through the visa process, whichever one is best for your circumstances, I am not sure, but I believe she will have to go through the residency criteria and that will take a few years, I can't remember how long.

She will have to do the LITUK test, TB test for anything longer than six months and then the Pledge to Queen and country.

So the answer is yes in the long run but not immediately. However, you will need to get through the visa application first and I reckon you need the knowledge of the visa guys on the other sub-forum, they might not visit here.

Thanks Moss, will also post in the visa forum. Just to answer a few of your questions:

Yes I do have proof, letters birthday cards, presents, and errrr..... our son.

I have a limited company in the UK, through which I do contract work, but because I have been staying in the UK, this has been "shelved" by the accountant.

Will I need to have income running through my UK company again to show proof of income? This means I would have to return alone to work and for how long would I need to show an income?

What are the LITUK test and TB test?

Although pretty conclusive, still not enough on its own, you will need to prove a sound family relationship, for all they know, you might not have seen him in the last three years, hence the above question.

I presume you mean Thailand, however I do not know the answer to this.

Don't know, but I think all you need to do is show proof of an independent income, without recourse to public funds.

Your partner can apply for an unmarried partner's settlement visa. The principal factor in this is that she will need to demonstrate that you have been in a relationship akin to marriage for at least the two years preceding the visa application. In order to show this, she will need to produce evidence that you have been living together such as joint tenancy agreements, bank statements, correspondence which you have both received at the same address etc. Obviously, that you have a son is good evidence of your relationship.

Your girlfriend will also have to demonstrate that you have either income or savings with which to support yourselves in the U.K. and that you have adequate accommodation too.

Hmmmm, seems simple enough. We can easily prove we have been together for 3 years. I own my house in the UK in which we all can live. My partner has a good income here, indeed we have a company together through which we both work. Am just not sure what visa she needs to apply for and the requirements. One hears a lot of stories of difficulties etc, and do not want to go back to UK unless my family can come with me. I have worked all my life and never claimed money from the state, so I hope this also has some bearing. I fugure I should call the embassy and just ask them exactly what visa my partner needs and the requirements. The people at the embassy in Bangkok have always been very helpful and courteous, so I hope we will be ok.
