I Have Two Passports and Have a Question re: 90 Day Reporting

I need to pick the brain of the collective.   

 

I have two passports, a US and an EU.   I entered Thailand around September visa exempt on my EU passport.  I did one border run and rec'd a second VE stamp.

 

During my stay, I decided to make Thailand my new home and signed an apartment lease.   The landlord registered me as an alien staying at an apartment.  I rec'd a TM30.   The TM30 has my EU passport info on it.   All good.  

 

Eventually, I exited Thailand and very recently (December 3) re-entered with a Non-Immigrant O visa.   Here's the catch.  I had to obtain the visa via my US passport so I entered using my US passport.  

 

So my question is:   must my landlord re-register me as an alien with my US passport details?   The only TM30 I have has my EU passport details on it.   When I attempt to do my visa extension in around 90 days, will this create a problem?    Will they say something like, "we have no record of you (the person with the US passport) registered as an alien living here..."   Or will having my apartment lease and current TM30 suffice?   

 

Upon arrival I sent my new visa details to my landlord and asked if she needed to re-register me.  She said she did not think she had to.  She was not being difficult or anything; I am not sure she understood the dual passport angle however.

My personal experience after having presented two separate and totally legal UK passports at Thai immigration over the years, when re-entering as visa-exempt (no visa in the passport), the immigration officer could see my other passport and my history of either marriage or retirement extensions on his computer. After calling a supervisor over, I was advised that I can only use the passport that has either a visa or an extension to enter, and that visa-exempt entry using the other passport wasn't allowed. If I insisted on using the other passport and a visa-exempt entry, they would cancel the visa in my other passport.

 

Although for many years, there was no evidence of them linking my passports by biometrics, they eventually did. There's also the long-standing 'non-alignment' between border immigration and local immigration, when it comes to 90-day reporting. Local immigration can fine you if you are late, but border immigration don't check if you depart and re-enter after you have missed a 90-day report. However, local immigration will probably pick up on it on any subsequent 90-day report after you re-enter. With the recently revised guidelines on visa-exempt entry and extensions thereof, I think the 'non-alignment' of border and local immigration will eventually disappear as their systems become more digitally integrated, so in my opinion it would be best to have the same passport with visa that was stamped in at the border as the one you will eventually present locally.

Yes. But strictly speaking, he would need to re-register you anyway, even if you had re-entered with the same passport. You cannot use a TM30 receipt dated before the day you entered with a new visa.

Jomtien (Chonburi) will likely issue you with a 1600 Baht fine and created a "late" TM30.

TY for replies so far.   OK...so 3 votes saying I must insist that the landlord re-register me with my US passport details.   

 

Reasons being a)  I cannot use a TM30 issued prior to my entry on a visa when I apply to extend my visa,

                           b)  The passport details on the TM30 must match those on the visa.


If one of the mods would offer their opinion, it would be much appreciated.   I also have to visit a visa agent shortly and I will run the question by them as well.

Visa agent.. for what. 

As to your situation can only suggest what I would do... 

Lease is a very simple thing for landlord to do. As is TM30. 

Suggest you make a new lease and also TM30

Your extension won't be denied, but Jomtien will want that updated TM30, with or without fining you or your landlord.

The overwhelming consensus is to insist that the landlord reregister me so that I receive a new TM30.    I'll tell her as much.

Go register yourself  if the landlord refuses 

You're not even here on the same passport the previous TM 30 was filed on, you're here as a totally "different person" (nationality wise) 

 

Of course you'd file a new TM 30 under the passport/nationality your here on now so you can get your yearly extension from this 90 day non o entry stamp. 

 

In many instances, especially with entry/visa/extension stuff, polling the audience for a consensu is hardly the way to go, but at least people are all telling you the correct answer, file a new TM 30.. (y)

 

And the experience @NanLaew had, holding two valid passports from the same country has no bearing on what you'd do holding passports from two different countries 😉 That's comparing apples to durian 🙂

The TM30, the Lease and your passport with the O Visa should all match or you could have problems later.

 

I also have more than one nationality, but I use only one - consistently - for the above (to live here).

 

BTW, many including me, have landlords that allow us to do our own updates of the TM30. It's mutually beneficial. But you'd be using the landlords credentials and passwords to file the TM30 updates each time, and the confirmation PDF is sent to the landlord's email - so s/he needs to forward it to you each time. I think it's different if you own a condo, etc., then you can just do your own without any 3rd party.

 

(Think you'll lose that EU passport if this new US Bill passes Congress? Of course, you could always renounce the US passport instead (and pay them no more tax). 😉

Trust me, I would prefer to get the definitive answer from a Thai IO or similar, but I need to sort of run with it because I thought I must be registered within 24hrs of arrival.  

 

Still, point taken.   Tomorrow I have time in the AM so maybe I can get to the Jomtien IO and ask someone in person.   These places are mad houses at moment unfortunately but hopefully I can go the "TM30 desk" and ask.

Resolved.  

 

Got the answer from Immigration Office.   90 minute wait for a 30 second conversation.  

 

Landlord needs to file a new TM30 with my US passport details.  

 

If my TM30 wasnt updated, I'd have hit a brick wall when trying to obtain a certificate of residency in order to open a bank account.

Which is why you need a new TM30 filed using your U.S. passport details. Get yer ducks in a row, it's not that difficult.

Getting a Non-O visa with a European passport may be better if issued by a country whose embassy can deliver a revenue statement. In that case no need to keep 800 000 bahts in a thai bank

The OP does not have a Thai bank account. 

The thread is regarding obtaining a COR in order to open bank account. 

As he posted earlier.....

The OP may find Kasikorn open a bank account since he has a Non O. 

COR may or may not be required.

At Jomtien, this is the desk where you notify your address to Immigration. (It can also be done online). It is typically done within 72 hours of returning to the address, particularly if returning from abroad or when changing address. 

 

The desk is located in the temporary building on the right as you go in between the Certificate of Residence Desk and the 90-day notification desk.
